Resolution 2013-22 RESOLUTION APPROVING THE DONATION OF THE OLD SCHOOLHOUSE TO THE CITY OF LA PORTE WHEREAS, the La Porte Independent School District ("District") owns the real property and improvements referred to herein as the "Old Schoolhouse." The Old Schoolhouse is located at 401 N. 5th Street, La Porte, Harris County, Texas. The legal description of the Old Schoolhouse is as follows: Lots 17 & 18, Block 90, City of La Porte, Harris County, Texas, according to the recorded map or plat thereof recorded in Volume 8, Page 16 of the Map Records of Harris County, Texas; and I_AlHFRFA.S, Texas Education Code Section 11.1541 and Board Policy CDB (Legal) provide that a school district may donate real property and improvements which were formerly used as a school campus to a municipality if the school district's board of trustees holds a public hearing concerning the donation, publishes notice of the hearing in a newspaper having general circulation in the school district, makes certain findings, and adopts a resolution authorizing the transfer of the property; and WHEREAS, the Old Schoolhouse was formerly used as a school campus; and WHEREAS, the Old Schoolhouse is no longer used by the District; and WHEREAS, The District does not need the Old Schoolhouse for educational purposes; and WHEREAS, The City of La Porte ("City") represents and warrants that, if the Old Schoolhouse is donated to it, the City will convert the Old Schoolhouse to a museum in order to preserve this historical building; WHEREAS, on September 10, 2013, a hearing before the Board of Trustees of the La Porte Independent School District ("Board") was held on the proposed donation of the Old Schoolhouse to the City, such date being at least seven (7) days after the date of publication of the notice of such public hearing; and WHEREAS, the Board at such public hearing invited any interested person to appear and speak for or against the donation of the Old Schoolhouse to the City; and WHEREAS, the proponents of the donation offered evidence in favor of all of the foregoing matters relating to the donation, and opponents, if any, of the donation appeared to contest the donation of the Old Schoolhouse. BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE LA PORTE INDEPENDENT SCHOOL DISTRICT. - SECTION 1. That the facts and recitations contained in the preamble of this Resolution are hereby found and declared to be true and correct. SECTION 2. That the Board, after conducting such hearing and having heard such evidence and testimony, has made the following findings and determinations based on the evidence and testimony presented to it:
