(a) That the public hearing on the donation of the Old Schoolhouse to the City has been properly called, held, and conducted, and that notices of such hearing have been published and posted as required by law; and (b) The Old Schoolhouse has historical significance; and (c) The donation of the Old Schoolhouse to the City will further the preservation of the Old Schoolhouse; and (d) The District does not need the Old Schoolhouse for educational purposes; and (e) The City has shown, to the satisfaction of the Board, that the City intends to continue to use the Old Schoolhouse for public purposes. SECTION 3. That pursuant to Texas Education Code § 11.1541 and Board Policy CDB (Legal), the Board, hereby adopts this Resolution authorizing the donation of the Old Schoolhouse to the City for the purposes described herein. SECTION 4. That the Board authorizes Board President Kathy Green to execute any documents necessary to effectuate this donation, including but not limited to a deed transferring ownership of the Old Schoolhouse to the City which complies fully with Texas Education Code § 11.1541(b). SECTION S. That, in the event the City discontinues the use of the Old Schoolhouse for public F, �m4o� purposes or executes a document purporting to convey the property, ownership of the Old Schoolhouse shall immediately revert to the District, pursuant to Texas Education Code § 11.1541(b). I l]p SECTION 6. That if any section, paragraph, clause, or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect any of the remaining provisions of this Resolution.
