<br />valuable consideration, cash to Us in hand paid by the City of La Porte, Texas,
<br />a municipality, the receipt and sufficiency of which is hereby acknowledged and
<br />confessed, have this day GRANTED, BARGAINED, SOLD AND CONVEYED and by these
<br />presents do GRANT, BARGAIN, SELL, AND CONVEY unto the said CITY OF LA PORTE,
<br />TEXAS, a municipality, its successors and assigns, for use by the City of La
<br />Porte, the perpetual right, privilege and easement, with appropriate rights of
<br />ingress and egress and reasonable working area for construction and maintenance,
<br />to enter upon and construct, reconstruct, maintain, operate, inspect, replace,
<br />repair and remove
<br />
<br />Potable Water Line and Aoourtenances.
<br />over and across certain '1 ands and premi ses owned by the sa i d GRANTOR, and located
<br />in the Johnson-Hunter Survey. Abstract Number A-35 , in Harris County, Texas,
<br />the property being burdened with said easement being described in a deed from
<br />Shoreacres M.H. Park. Inc. to Carlsberg M.H. Properties LTD dated 12/28/71
<br />and recorded under File Number D 492978, in the File Codes of Harris County,
<br />Texas, and further described below:
<br />
<br />COMMENCING at a 5/8 inch iron rod on the North right-of-way line of McCabe
<br />Road (80' ROW) marking the Southwest corner of the abandoned Tidewood
<br />Subdivision, Section 1 (Vol. 66, Pg. 61, H.C.M.R.) and the Southwest corner
<br />of that certain Carlsberg Mobile Home Properties, Ltd. tract (H.C.C.F. No.
<br />o 492978).
<br />
<br />THENCE, N. 0 degrees 16 minutes E; coincident with the West boundary line
<br />of said abandoned Tidewood subdivision and said Carlsberg Mobile Home
<br />Properties, Ltd. tract; passing at 300.00 feet a 5/8 inch iron rod marking
<br />the most southerly southeast corner of that certain City of La Porte-Bay
<br />Forest Golf Course 69.35 acre tract (H.C.C.F. No. K 784741); for a total
<br />distance of 305.00 feet to the POINT OF BEGINNING of this 10 feet wide
<br />waterline easement.
<br />
<br />THENCE, S. 89 degree 44 minutes E; coincident with the centerline of this
<br />10 feet wide waterline easement; a distance of 45 feet to the POINT OF
<br />TERMINATION of this easement.
<br />
<br />TO HAVE AND TO HOLD the above described easement, together with all and
<br />singular the rights and appurtenances thereto in anywise belonging unto the said
<br />CITY OF LA PORTE, TEXAS, its successors and assigns, in accordance with the terms
<br />and conditions hereinabove set forth. The GRANTOR does hereby bind himself, his
<br />heirs, executors and administrators to WARRANT AND FOREVER DEFEND, all and
<br />singular the said easement' unto the said CITY OF LA PORTE, TEXAS, its successors
<br />and assigns, against every person whomsoever lawfully claiming or to claim the
