All paving will be to City of La Porte specifications. The City of La Porte will accept this public portion of the paved right-of-way of Old La Porte Road for permanent maintenance, upon its completion by Bickham's contractor. Bickham Industries, Inc. will be responsible f'or the receiving of quotes, hir ing and supervision of the contractors, and payment, of all bills for labor and material for such paving. The City of La Porte reserves the right to approve the contractor, contract documents, insurance, etc. Work is to be performed according to the specifications recommended by Aviles Engineering Corporation in May, 1989. Any additional base material supplied by the City of La Porte will be spread, mixed and compacted by the Bickham's contractor. 3. Bickham Industries, Inc. agrees to execute and deliver to the City of La Porte, easements for existing City of La Porte water and sewer mains in place. In addition, the City of La Porte shall have the right under the terms of such easement, to construct other and further water, sewer, and public drainage facilities within the 60' right-Of-way of Old La Porte Road, described on Exhibit .C. attached hereto, as may be necessary. Included in the easement rights are the right of entry on the paved portion of such road for City of La Porte and other public utility service and emergency vehicles. The City of La Porte will assume responsibility for the performance of the following: 1. The City of La Porte agrees to prepare plan/profile drawings for the public portion of the roadway improvement. Any shortage in base material will be supplied by the City (material only). 2. The City agrees to prepare drawings for drainage'improvements for both public and private sections of the roadway. 3. The City agrees to perform excavation and placement of drainage structures for both the public and private sections of the roadway and to return the surface of driveways to pre-existing condition. If this letter accurately sets forth your understanding of the terms and provisions of the agreement between Bickham Industries, Inc. and the City of La Porte, please sign and return one copy of this letter to the City of La Porte, retaining the other copy as your copy of the agreement.
