AGREEMENT (for privately-funded extensions), Page 3 <br /> <br />(6) The Owner shall retain a Texas Registered Professional <br />Engineer with municipal utilities experience to prepare <br />construction plans and specifications and the construction <br />contract for the extension, according to the City's standards <br />and specifications. Owner's selection of professional <br />engineer shall be approved in advance by the City. <br /> <br />(7) Upon City approval of said plans and specifications and the <br />proposed construction contract, Owner shall enter into a <br />contract with a qualified municipal utilities contractor to <br />construct the extension. However, if City of La Porte funds <br />are included in the extension, competitive bids would be <br />necessary in order to comply with City of La Porte Charter <br />and State law. Owner's selection of Contractor shall be <br />approved by the City prior to execution of the contract. <br />Contractor shall furnish Certificates of Insurance to Owner <br />and City, certifying insurance coverages by Contractor in <br />amounts customarily required by City of its contractors. <br /> <br />(8) Upon City issuance of a written Notice to Proceed to the <br />Owner, the Owner's Contractor shall diligently pursue the <br />construction of the project to completion in accordance with <br />the City approved plans and specifications. The Owner's <br />Engineer shall inspect said construction, certify it in <br />writing as having been completed in accordance with the City <br />approved plans and specifications, and submit record drawings <br />on mylar film of the completed extension to the c~ty. The <br />Contractor shall furnish to the City a written warrenty <br />covering defects in material and workmanship in the completed <br />project within one (1) year from the date of completion. <br />Owner shall insure that the Engineer and Contractor perform <br />as specified herein. <br />
