AGREEMENT (for privately-funded extensions), Page 4 <br /> <br />(9) <br /> <br />After City <br />extension(s) <br />utility taps <br /> <br />approval and acceptance of said completed <br />for ownership and maintenance, Owner may request <br />to the extension. <br /> <br />(10) Upon transfer of ownership of the completed extension to the <br />City, City agrees to accept the value of the extension as a <br />pro rata portion of the prevailing connection charge for <br />water and/or sewer service against said property belonging to <br />Owner. Owner shall be responsible for all other customary <br />charges. <br /> <br />(11) In the event that other owners of property abutting the line <br />extended by Owner under this contract shall utilize the <br />extended line constructed under this agreement, by making <br />connection thereto under a permit from City within a period <br />of ten (10) years from and after the date City has accepted <br />the construction of said facilities by the Contractor, City <br />agrees to collect from said property owners, its prevailing <br />connection fees from said property owners and to reimburse <br />Owner the amount collected from such property owners, until <br />Owner has been reimbursed a maximum total of the sum paid by <br />Owner to the Contractor under the terms of their contract, <br />less Owner's own water and/or sewer connection charges. In <br />the event that other Owners have participated in the cost of <br />the extension of this line, all participating owner shall be <br />reimbursed pro rata to their respective participation in the <br />cost of the extension. <br /> <br />(12) The executio~ of this agreement commits the applicant to the <br />minimum extension described earlier and will be sufficient <br />evidence of said extension to allow for the issuance of a <br />building permit for the applicants proposed building <br />expansion. <br />
