NAT. RES. CODE (V. T. C. A. <br />1978). Failure of Lessee to make a payment on or before the date <br />the same becomes due shall, at the option of Lessor, make all <br />payments due and payable immediately. <br /> <br />Article IV. Taxes <br /> <br />section 4.01. Lessee shall, as further consideration for this <br />Lease, pay and discharge "Taxes" (as hereinafter defined) each <br />calendar year (or portion thereof) of this Lease. For the purposes <br />of this Lease, the term "Taxes" shall mean and refer to all taxes, <br />assessments, impositions, levies, charges, excises, fees, licenses <br />and other sums (whether now existing or hereafter arising, whether <br />foreseen or unforeseen and whether under the present system of real <br />estate taxation or some other system), which during the term of <br />this Lease may be levied, assessed, charged or imposed by any <br />governmental authority or other taxing authority or accrue on the <br />Leased Premises and any improvements or other property thereon, <br />whether belonging to Lessor or Lessee, or to which either of them <br />may become liable in relation thereto. The term "Taxes" shall also <br />include all penalties, interest and other charges payable by reason <br />of any delay or failure or refusal of Lessee to make timely <br />payments as required pursuant to this Section 4.01. <br /> <br />section 4.02. Lessee agrees to and shall protect and hold harmless <br />Lessor and the Leased Premises from liability for any and all <br />Taxes, together with any interest, penalties or other sums thereby <br />imposed, and from any sale or other proceeding to enforce payment <br />thereof. <br /> <br />section 4.03. Lessee agrees to pay all Taxes directly to the <br />applicable taxing authority not less than fifteen (15) days prior <br />to the date of delinquency thereof. <br /> <br />Article V. Use of Premises <br /> <br />section 5.01. Lessee shall have the right to use the Leased <br />Premises solely for the operation of a public fishing pier. Lessee <br />shall not use the Leased Premises for any other purpose without <br />obtaining the prior written consent of Lessor, which consent may be <br />granted or withheld by Lessor in it's sole discretion. <br /> <br />Section 5.02. Lessee, at its own expense, will comply with all <br />federal, State, municipal and other laws, codes, ordinances, rules <br />and regulations applicable to the Leased Premises; will install, <br />remove and alter such equipment and facilities in, and make such <br />al terations to, the Leased Premises as may be necessary so to <br />comply; will comply with such regulations as Lessor may promulgate <br />regarding sanitation, cleanliness and other health and/or <br />environmental matters, including,without limitation, removal of <br />
