Lessee will not make any unlawful <br />use of the Leased Premises or permit any unlawful use thereof; and <br />will not commit, or permit anyone else to commit, any act which is <br />a nuisance or annoyance to Lessor or adjacent property owners or <br />tenants, or which might, in the exclusive judgment of Lessor, <br />appreciably damage Lessor's goodwill or reputation, or tend to <br />injure or depreciate the value of the Leased Premises and/or any <br />improvements located thereon. Lessee's activities at the Leased <br />Premises will not restrict or prevent other persons or entities <br />from navigating open, navigable waters located thereon. <br /> <br />. <br /> <br />section 5.03. Lessee shall use the highest degree of care and all <br />proper safeguards to prevent pollution of air and water in and <br />around the Leased Premises. In the event of pollution, Lessee <br />shall use all means at it's disposal to recapture all pollutants <br />which have escaped and shall be responsible for all damage to <br />public and private property caused thereby. <br /> <br />Section 5.04. Lessee shall insure that all improvements const~ucted <br />by it . and/or operated on the Leased Premises are visible to <br />operators of marine craft at all times. Lessee shall further take <br />any and all steps necessary to insure that improvements constructed <br />by it and/or placed or operated on the Leased Premises do not <br />constitute a hazard to operators of marine craft. <br /> <br />Article VI. Construction by Lessee <br /> <br />Section 6.01. Lessee shall make no alterations, additions or <br />changes in the Leased Premises without the prior written consent of <br />Lessor. <br /> <br />Section 6.02. Prior to termination of the Lease, Lessee will <br />demolish or remove all or any portion of the improvements then <br />existing on the Leased Premises, remove all debris resulting from <br />such demolition, and leave the ground theretofore occupied by such <br />improvements in a safe, c1ean condition, all such work to be done <br />as promptly and expeditiously as is reasonably possible. <br /> <br />If Lessee fails to comply with the foregoing, Lessor shall have the <br />right to perform the aforesaid requested work, in which event <br />Lessee shall be liable to Lessor for all loss and damage sustained <br />by Lessor (including, without limitation, loss of rent and interest <br />at the highest non-usurious rate permitted by law) as well as for <br />the cost and expense incurred by Lessor in connection therewith as <br />well as all costs and expenses (including reasonable attorneys' <br />fees) incurred by Lessor in attempting to effect collection <br />thereof. <br /> <br />Article VII. Repair and Maintenance <br /> <br />Section 7.01. Lessor shall have no duty to repair or maintain the <br />Leased Premises or any improvements placed at or constituting any <br />
