<br />TEXAS, its officers, agents, servants, attorneys and employees, of and from any and all liability,

<br />actions, causes of action, claims, demands, or suits whatsoever, which they may now or hereafter

<br />have or claim to have, on account of or arising out of the right of entry agreement attached hereto

<br />between them and the CITY OF LA PORTE, TEXAS, true and correct copies of which are

<br />attached to this Release and further release, acquit and forever discharge the CITY OF LA

<br />PORTE, TEXAS of and from any and all liability, actions, causes of action, claims, demands or

<br />suits whatsoever, which they may now have or hereafter claim to have, arising out of Cause No.
<br />
<br />686,222, styled CITY OF LA PORTE, TEXAS v. FRYMORE CORPORATION and LIEBE
<br />
<br />CORPORATION, now pending in County Civil Court at Law No, 4 of Harris County, Texas,
<br />
<br />For and in consideration of the above release by EMERY FARKAS individually and on
<br />
<br />behalf of LIEBE CORPORATION, and his attorney DAVID H. MELASKY, the CITY OF LA
<br />
<br />PORTE, TEXAS releases all of its right, title and interest in and to the following described real
<br />
<br />property in Harris County, Texas which is the subject of the pending condemnation case, Cause
<br />
<br />No 686, 222, in County Civil Court at Law No.4 of Harris County, Texas:
<br />
<br />BEING A 10 FOOT WIDE UTILITY EASEMENT ACROSS LOTS 9 THROUGH
<br />16, BLOCK 143, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, THE
<br />HARRIS COUNTY DEED RECORDS, LOTS 9 THROUGH 16 BEING
<br />CONVEYED TO THE FRYMORE CORPORATION BY INSTRUMENT
<br />RECORDED UNDER HARRIS COUNTY CLERK'S FILE NO. R381873, SAID
<br />UTILITY EASEMENT BEING MORE PARTICULARLY DESCRIBED BY
<br />METES AND BOUNDS ON EXHlBIT "A" ATTACHED HERETO,
<br />INCORPORATED BY REFERENCE HEREIN, AND MADE APART HEREOF
<br />FOR ALL PURPOSES.

<br />EMERY FARKAS, individually and on behalf of LIEBE CORPORATION and his
<br />
<br />attorney, DAVID H. MELASKY, agree not to file or record this settlement agreement and
<br />
<br />release for one hundred and twenty (120) days after the date of their signatures below.
