PlanningandZoningCommissionRegularMeeting <br />March19,2015 <br />BeachParkͻ/źƩĭƌĻƭͼZoneChange <br />PlanningandDevelopmentDepartment <br />StaffReport <br />ISSUE <br />ShouldthePlanningandZoningCommissionrecommendapprovaltotheCityCouncilof <br />theproposedcityinitiatedrezoningofLots128,Block29;Lots128,Block30;Lots1 <br />28,Block31;Lots128,Block32;Lots710,Block49;BeachParkSubdivision,Harris <br />County,Texas,fromNeighborhoodCommercial(NC)toMixedUse(MU)? <br />RECOMMENDATION <br />StaffrecommendsthePlanningandZoningCommissionconsiderarecommendationfor <br />approvaloftheproposedcityinitiatedzonechangerequestfromNeighborhood <br />Commercial(NC)toMixedUse(MU). <br />DISCUSSION <br />Location: <br />Thefollowingarethelegaldescriptionsofallpropertiesincludedaspartofthis <br />rezoning:Lots128,Block29;Lots128,Block30;Lots128,Block31;Lots128,Block <br />32;Lots710,Block49;BeachParkSubdivision,HarrisCounty,Texas. <br />: <br />BackgroundInformation <br />TheLaPorteCityCouncilrecentlyapprovedanumberofmodificationstotheĭźƷǤ͸ƭ <br />ZoningOrdinance.Oneofthosechangeswasthecreationofanewzonedistrictcalled <br />theMixedUseDistrict.Thisdistrictwasestablishedinresponsetorequestsfrom <br />propertyownerswithinthecircleareaslocatedadjacenttoSylvanBeachPark.Those <br />propertyownerssuggestedCouncilconsiderallowingtheconstructionofsinglefamily <br />residentialhousesonlots.Thesubjectpropertiesproposedtoberezonedarecurrently <br />zonedNeighborhoodCommercial(NC)andascurrentlyzoned,theconstructionofa <br />singlefamilyhouseisnotpermitted. <br />TheMixedUse(MU)zonedistrictwascreatedtoallowforresidentialandlimited <br />commercialusesoramixofresidentialandcommercialusesscaledinsuchamanneras <br />tocomplementtheimmediateneighborhoodanditsresidentialcharacter.Specifically, <br />theMUdistrictallowsforconstructionofsinglefamilyresidentialdevelopmentandthe <br />abilitytobuildahouseonapropertywithinthisarea. <br />1 <br /> <br />
