<br />2.Allnecessarydocumentationforbuildingpermitreviewmustbe
<br />submittedinconjunctionwiththeĭźƷǤƭbuildingpermitapplicationprocess.
<br />3.AllusespermittedintheCityofLaPorteZoningOrdinanceUseChart
<br />underLI,asmaybeamendedfromtimetotime,arepermittedexceptaslimited
<br />inthisSCUP.ForusesnotauthorizedbythisSCUP,approvalpursuanttoSection
<br />106216&106217oftheCityofLaPorteCodeofOrdinances,asitnowexistsor
<br />maybeamendedfromtimetotime,shallberequired.
<br />4.Thefollowingusesshallnotbepermittedonthesubjectproperty:(a)any
<br />distilling,refining,smelting,meat,poultryorfishprocessingplant,agriculturalor
<br />miningoperation;(b)anymobilehomepark,trailerpark,laborcamp,or
<br />stockyard(exceptthisprovisionshallnotprohibitthetemporaryuseof
<br />constructiontrailersduringperiodsofconstructionorreconstruction);(c)junk
<br />metalyardorwastematerialbusiness,salesinbulkofjunk,
<br />yard,scrap
<br />automobilewreckingyard,salvageyard,asphaltplant,anystorage,dumping
<br />disposal,incinerationorreductionofhazardouswaste,garbageorrefuse,any
<br />fireorbankruptcysaleorauctionhouseoperation,orasanairport;(d)any
<br />(e)school,churchorgovernmentaloffice(otherthan
<br />mortuaryorfuneralhome;
<br />aresearchordevelopmentorbusinessofficethatdoesnothavecustomers);(f)
<br />anydrilling,refining,quarryingorminingoperationsofanykind;(g)any
<br />establishmentwhoseprimarybusinessisthesaleorrentalordisplayofsexual
<br />materialsordrugrelatedparaphernaliaorwhoseprimarybusinessisproviding
<br />anyadultonlysexuallyorientedserviceorproductincluding,butnotlimitedto,
<br />massageparlors,toplessestablishments,anyͻğķǒƌƷͼbookstoreorͻğķǒƌƷmovie
<br />theater;(h)anyfleamarket,bowlingalley,nightclub,bar,lounge,tavern,theater,
<br />amusementparkorvideoarcade;provided,however,thatthisprohibitionshall
<br />notprohibitplacementofvideomachinesthatareincidentaltotheconductofa
<br />permittedbusinessatthesubjectproperty;(i)anyoutdoorsalesasaprimaryor
<br />accessoryuse;(j)anyoutdoorstorageasaprimaryoraccessoryuse,including
<br />anystorageofshippingcontainers;and(k)anygamingfacilityoroperation
<br />including,butnotlimitedto,offtrackorsportsbettingparlor,tablegamessuch
<br />asblackjack,kenomachinesorsimilardevicesorbingohall.Notwithstandingthe
<br />foregoing,thisprohibitionshallnotapplytoanygovernmentsponsoredgaming
<br />activitiesorcharitablegamingactivitiessolongassuchgovernmentalor
<br />charitableactivitiesareincidentaltothebusinessbeingconductedbythe
<br />occupantofthatportionofthesubjectpropertyanddonotoccurregularly.
<br />5.Nouseshallbepermittedwhich(a)isoffensivebyreasonofodor,fumes,
<br />dust,smoke,noise,vibrations,radiation,radioinfluenceorpollution,(b)is
<br />hazardousbyreasonofexcessivedangeroffireorexplosion,(c)otherwise
<br />constitutesanuisance,(d)isdangerousorunsafe,(e)wouldinjurethe
