PlanningandZoningCommissionRegularMeeting <br />August20,2015 <br />GCPSCUP <br />Conclusion: <br />Basedontheanalysisabove,stafffindsthatifthePlanningandZoningCommission <br />desirestorecommendapprovaloftheproposedSpecialConditionalUsePermit,thena <br />numberofconditionsshouldbeconsideredintheapproval.Theproposedwarehouse <br />facilityisconsistentwiththeintentofhowthePortCrossingareawasintendedto <br />develop.AlthoughthispropertyisnotownedbyPortCrossing,itispartofthePUD <br />zonedPortCrossingarea. <br />Section106217oftheZoningOrdinanceoutlinesspecificconditionsforapprovalof <br />SCUPapplications.Therearethreedifferentconditionsthatmustbemetinorderto <br />approveaSCUP.ThefollowingtableidentifieseachofthethreeconditionsandƭƷğŅŅƭ <br />findingoneach: <br />Condition:StaffAnalysis: <br />(1)ThatthespecificusewillbeTheproposeduseasawarehousefacilityisconsistentwiththe <br />compatiblewithandnotsurroundingdevelopmentinthevicinity.Thedevelopmentofthissite <br />injurioustotheuseandwillenhancethepropertyvaluesintheareaandisasignificant <br />enjoymentofotherproperty,investmentinthecommunity. <br />norsignificantlydiminishor <br />impairpropertyvalueswithin <br />theimmediatevicinity. <br />(2)ThattheconditionsplacedonAsaconditionofapprovaloftheproposedSCUP,theapplicantis <br />suchuseasspecifiedineachrequiredtosubmitasitedevelopmentplaninaccordancewiththe <br />districthavebeenmetbytherequirementsoftheĭźƷǤƭDevelopmentOrdinance.Additionally,the <br />applicant.sitedevelopmentplanwillneedtocomplywithallotherprovisionsof <br />theĭźƷǤƭZoningOrdinanceandwillbereviewedduringthesite <br />developmentreview. <br />(3)ThattheapplicanthasagreedTheapplicantwillneedtoconfirmontherecordatthepublichearing <br />theSCUP.Staff <br />tomeetanyadditionalthattheyareagreeabletotheconditionsimposedon <br />conditionsimposed,basedonhasprovidedalistofconditionsaspartofthisreport.However,the <br />specificsiteconstraints,andCommissionandCityCouncilmayimposeadditionalconditions, <br />necessarytoprotectthepublicshouldtheyapprovetheproposedSCUP. <br />interestandwelfareofthe <br />community. <br />ShouldthePlanningandZoningCommissionrecommendapprovaloftherequested <br />SCUPapplication,staffrecommendsthefollowingconditionsbeconsidered: <br />1.Asitedevelopmentplanshallbesubmittedinaccordancewithapplicable <br />requirementsoftheCityofLatƚƩƷĻƭDevelopmentOrdinanceandshallcomply <br />withallprovisionsofChapter106,ͻƚƓźƓŭͼofthe/źƷǤƭCodeofOrdinancesand <br />allotherdepartmentreviewsandapplicablelawsandordinancesoftheCityof <br />LaPorteandtheStateofTexas. <br />4 <br /> <br />
