Zoning Board of Adjustment <br />Minutes of April 28, 2011 <br />Members Present Rod Rothermel, Gilbert Montemayor (Alt. No. 2), Charles Schoppe, and T.J. <br />Walker <br />Members Absent George Maltsberger, Lawrence McNeal (Alt. No 1), and Chester Pool. <br />City Staff Present Traci Leach, Assistant City Manager, Masood Malik, City Planner; Knox Askins, <br />City Attorney; Shannon Green, Planning Assistant. <br />1. Call to Order. <br />Vice Chairman Rod Rothermel called the meeting to order at 6:12 p.m. <br />2. Consider approval of the March 24, 2011, meeting minutes. <br />Motion by T.J. Walker to approve the Minutes of March 24, 2011. Second by Charles Schoppe, <br />Motion carried. <br />Ayes: Rod Rothermel, Gilbert Montemayor (Alt. No. 2), Charles Schoppe, and T.J. Walker <br />Nays: None <br />Abstain: None <br />Consider Special Exception Request #11- 94000001 for the property located at 125 South 3 rd <br />Street, further described by the Harris County Appraisal District as being Lots 11 -16, Block <br />39, Town of La Porte, Harris County, Texas. The City of La Porte, property owner, seeks <br />reduction of a side yard setback from 10' to 0' adjacent to West `A' Street and from 20' to 0' <br />along the rear yard, and an exception for installation of eaves or downspouts adjacent to <br />public right -of -way for proposed Fire Station No. 1. These exceptions are being sought under <br />the terms of Section 106- 191(b)(2) of the Code of Ordinances of the City of La Porte. <br />A. STAFF PRESENTATION <br />Masood Malik, City Planner, presented staff's report. <br />Seventeen public hearing notices were mailed to property owners within 200' of the <br />subject property. The City received one response in favor of the Special Exception and <br />two were returned undeliverable. <br />B. PROPONENTS <br />There were none. <br />C. OPPONENTS <br />Brenda Brown of 631 Fairfield, Shoreacres is a property owner of 113 S. 3' Street. Ms. <br />Brown did not feel there was sufficient notice given to the property owners. Ms. Brown <br />voiced her concern for the noise and traffic the proposed Fire Administration building <br />might bring to the neighborhood. <br />D. PROPONENTS REBUTTAL <br />There were none. <br />Motion by Gilbert Montemayor to approve Special Exception Request #11- 94000001, for the <br />property located at 125 South 3 Td Street to reduce a side yard setback from 10' to 0' adjacent to <br />West 'A' Street and from 20' to 0' along the rear yard, and an exception for installation of eaves or <br />downspouts adjacent to public right -of -way for proposed Fire Station No. 1.
