The proposed structure would be located approximately 2 miles north of the~LaPorte Municipal Airport, La Porte, Texas. It would exceed the obstruction standards of Federal Aviation Regulation Part 77, Subpart C, Section 77.23(a)(2~ by 170 feet, a height in excess of 200 feet above ground level within three nautical miles of the La Porte Municipal Airport. The proposal was circularized to all known potentially concerned aviation and nonaeronautical interests by letter dated July 25, 1977. There were two responses received as a result of the circularization. The Mayor of the City of La Porte objected on the basis that he believed the proposed structure would interfere with aircraft landing or departing runway 12 at the La Porte Municipal Airport. The Texas Aeronautics Commission objected on the basis the La Porte Municipal Airport development program and the airport will have a nonprecision instrument approach. The Aeronautical Study of the proposal disclosed the following: The construction of the proposal would not require revision of any existing or planned instrument flight rule (IFR) procedure operation or minimum flight altitude. The proposed structure would be located in an industrial area, which is well defined, and is approximately 1 mile southeast of an existing 420° AGL, 454' AMSL, structure and is located approximately 1.25 miles northeast of the extended center line of runway 12 at the La Porte Municipal Airport. The structure is of sufficient distance from the La Porte Municipal Airport so as not to interfere with aircraft approaching or departing runway 12 or any other runway on the airport. In addition, the structure would not be located in proximity to VFR traffic pattern operations at the La Porte Municipal Airport. Therefore, based upon the findings. of the Aeronautical study., the proposed flare tower would not have a substantial adverse effect upon IFR (present or planned) or VFR aeronautical activity and would not be a hazard to air navigation provided the structure is appropriately marked and lighted'in accordance with standard marking and lighting procedures. This determination issued in accordance with FAR Part 77 does not preempt, cancel, alter, supersede, or suspend any ordinances, laws, or regulations of any governmental body or agency. A request for extension of the effective period of this determination should be submitted by the proponent not less than IS days prior to the expiration date. •
