• <br />• Regular Meeting 10/23/74 - Continued <br />14. DISCUSS ENGINEERING CONTRACTS - (CONTINUED) <br />There is an engineering services contract and a <br />separate boring contract. Mr. Askins stated that <br />the contract for engineering services was a <br />standard contract and was acceptable with the <br />Engineer and himself. However, under the terms <br />of the settlement, this is one of the items that <br />will be paid for in full by the Railroad. <br />• <br />Turner, Collie & Braden will submit their invoices <br />to the City. We will turn them over to the Railroad <br />and they in turn will pay Turner, Collie & Braden <br />direct. This is in accord with the Judgment. <br />The Attorney was of the opinion that written approval <br />should be received from the Railroad, for our files, <br />on each stage. <br />10 <br />A meeting was held between Turner, Collie & Braden and <br />Southern Pacific, at which time, some of clauses were <br />changed. There was no representative from the City <br />present. <br />Mr. Askins stated that he was in a position to recommend <br />to the Commission to authorize the Mayor and City Clerk <br />to execute the contracts on behalf of the City. The <br />necessary changes will be made before the contracts are <br />executed and returned. A cover letter will be prepared <br />by the Attorney giving Turner, Collie & Braden formal <br />notice that the money for this project will come from <br />Southern Pacific and the City of La Porte will have no <br />monetary obligation. <br />The City will pay for Mr. Busch's Engineering Services <br />and initialing Turner, Collie & Braden's invoices before <br />sending them to Southern Pacific for payment. <br />It was determined that some preliminary work has already <br />begun for the project. <br />Upon the recommendation of the City Attorney and the <br />Engineer, motion by Commissioner Christensen, seconded <br />by Commissioner Price to authorize the City Attorney to <br />prepare the necessary letters and authorize the Mayor <br />and City Clerk to execute the contracts after the necessary <br />corrections had been made.
