C • Joint Public Hearing 10/04/78 2 1. CALL TO ORDER - Mayor Meza called the public hearing to order. + + + 2. CONSIDER REZO ING BLOCK 30, BEACH PARK,-HARRIS COUNTY, fiEXAS, FROM RESTDEN''I'IAL TO "C" APARTMENT AND COMMERCIAL - The public hearing was opened and Pat Muston, c airman of the Planning & Zoning Commission read a recommendation that only Lots 1, 2, and 3, Block 30, Beach Park, be rezoned to commercial classifi- cation with limited use. A copy of the recommendation is attached and made a part of these minutes.. Mayor Meza asked if there was anyone else desiring to speak for the rezoning? There was no one. Mayor Meza asked if there was anyone desiring to speak against the rezoning? A letter was read from Mr. Sam K. McLelland opposing the rezoning. A copy of the letter is attached and made a part of these minutes. • Commissioner Cline asked if Mr. McLelland owned property within Block 30? The City Clerk affirmed. Commissioner Tomerlin asked what the Planning & Zoning Commission intended in regard to the recommendation for limited use? The intent was to prohibit the sale of beer and alcohol. It was determined that the Ordinance limited the locations for the sale of on premise consumption. Each individual location would have to have prior approval of the City Commission. There was a brief discussion regarding permitted uses for the property and whether it should be rezoned or remain residential. Motion by Commissioner Cline, seconded by Commissioner Simons that the meeting recess for one hour to allow the Planning and Zoning Commission to make a recommendation. Motion carried by the following vote: AYES: Commissioners Tomerlin, Kibodeaux, Cline, and Simons. NAYS: None. The meeting recessed at 7:14 P.M. • ~ The meeting reconvened at 8:00 P.M.
