By <br />Section 26(e) of the Act the Commission is directed to fix <br />by final order such rates as should have been fixed by the <br />municipality. By filing of this Petition for Review within <br />thirty days of the final decision of the City Council, HL&P <br />hereby invokes the appellate authority of this Commission: <br />V. <br />HL&P believes that the rate ordinance adopted by <br />the City fails to provide adequate rate relief and that said <br />ordinance fixes the rates of HL&P within the City at a level <br />that would fail to provide overall revenues sufficient to <br />permit HL&P to recover its operating expenses together with <br />• a reasonable return on its invested capital as provided in <br />Section 39 of the Utility Act. In addition, the City has <br />failed to base its rates on the proper adjusted value of <br />invested capital of HL&P as provided in Section 41 of the <br />Utility Act. As evidence in support of these contentions, <br />HL&P requests that the Commission incorporate by reference <br />the rate filing package, supporting testimony, and hearing <br />• record before the Commission in Docket No. 2676. <br />-2- <br />
