~ ~ <br /> <br />VI. <br />HL&P further alleges said ordinance requires rates <br />that are unreasonably preferential, prejudicial and discrimi- <br />natory in application to various classes of customers in <br />contravention of Section 38 of the Utility Act. <br />VII. <br />The City's ordinance requires that conforming rate <br />• <br />schedules be filed within ten days of fir_al passage. HL&P <br />believes it is in the public interest to have uniform rates <br />throughout its service area. Therefore, HL&P requests that <br />this Commission declare Ordinance No. 1179 of the City to <br />be vacated by the filing of, this Petition for Review and <br />substitute rates based on the Examiner's Report in Docket No. <br />2676 as interim rates within the City pending final resolution <br />of this appeal. HL&P further requests that the rates finally <br />set in Docket No. 2676 be fixed by Final Order in this <br />docket as well. <br />WHEREFORE, HL&P requests that the Commission <br />r: <br /> <br />declare Ordinance No. 1179 of the City of .LaPorte to be <br />vacated by the filing of this Petition, that the Commission <br />institute a de novo proceeding to fix rates to be applied <br />within the City, that interim rates be allowed to become <br />effective at the earliest possible date and to remain effec- <br />tive pending final resolution of this appeal, and that HL&P <br />-3- <br />
