Box 44 Tonawanda, New York 14150 Dear Mr. Jehle: This letter is to confirm the consensus of the LaPorte City Council at its meeting of October 22, 1980, concerning the request contained in your letter of September 30, 1980. The City of La Porte is agreeable to the following: 1) That the property known as the Cockburn Estate Property as described in your letter, be included in the Battleground Industrial District of the City of La Porte, Texas. 2) That the City of La Porte enter into an Industrial District contract with Union Carbide Corporation, on the City's Standard Form of Industrial Agreement, copies of which have previously been furnished to you and to •.your attorney, Mr. Frank Hubert, Jr. of Baker and Botts, with the addition of the language proposed by Mr. Hubert in his letter to Knox. W. Askins, La Porte City Attorney, of October 20, 1980,-with further addition of "industrial waste" to paragraph (2) (c). 3) As to your request for disannexation, it is .the practice of the City of La Porte, in connection with Industrial District Agree- ments, that 25% of the value of the industrial facility remain annexed to the City of La Porte. The selection of the portion to remain annexed is a matter which should be worked out between you and the City of La Porte's Tax Engineering Consultant, Mr. Hugh Landrum, whose address and telephone number are as shown below.
