•~ • <br />6. PAYMENT - ACTUAL COST. Estimates for each individual project <br />• shall be furnished to the STATE for review and approval prior to any <br />installation work. These estimates shall be sufficiently detailed to <br />show the work to be done and the materials to be installed. <br />The RAILROAD may submit monthly bills of at least .$500.00 prepared in <br />satisfactory form for work performed and materials installed. Payment <br />will be made for as much as 90% of the costs detailed on the bill. <br />The RAILROAD will, in any event, submit a complete and final bill, <br />including all .costs, when the project is completed and the STATE will <br />pay to the RAILROAD as much as 90/ of the costs detailed on the bill. <br />After the final audit, the STATE will make a final payment of the re- <br />maining balance due the RAILROAD. <br />The RAILROAD may also request, under current STATE policies, payment <br />for. materials in reasonable proximity to project, but not in place. <br />The RA~YLROAD shall retain adequate cost accounting records for auditing <br />purposes for three years after the final :payment. <br />7. MAINTENANCE. The RAILROAD shall maintain and operate these <br />• highway-railroad grade crossing warning systems as installed and in <br />accordance with the design of~operation as shown in the EXHIBIT B. <br />No changes are to be made in the design, operation or location of the <br />warning systems without the written. approval of the STATE or MUNICIPALITY <br />of jurisdiction. <br />8. All provisions concerning the STATE which are -stipulated herein <br />shall automatically cease and terminate upon official completion of the <br />projects and payments of the final bill, where the crossings covered <br />herein are not on the State Highway System. The MUNICIPALITIES of <br />jurisdiction in such case shall assume the rights of the STATE after <br />payment of the final bill. <br />9. PROJECT ADDITIONS AND CANCELLATIONS. Individual projects may <br />be added to or cancelled from the EXHIBITS L attached hereto and made <br />a part hereof with the mutual consent of the STATE and RAILROAD, <br />As the Federal Government plans to continue contributing funds for im- <br />provement and/or installation of warning devices for at least four years, <br />the STATE .may submit additional EXHIBITS L listing additional individual <br />projects to be attached hereto and made a part hereof. <br />• <br />3 <br />D-SRR <br />5-11-79 <br />~~ <br />
