Minutes of R~lar Meeting-1-21-81 • <br />Page 2 <br />• anyone had tried to contact the owner of the other lots. <br />Councilman Kibodeaux replied that the owner of those lots is <br />a lady who lives in Houston and a year or so ago Mr. Berringer <br />and the City had talked to her about closing the lots and she <br />was not interested. <br />The motion was second by Councilman Tomerlin. The motion carried <br />4 ayes and 0 nays. <br />Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman <br />Cline, Councilman Simons <br />Nays: None <br />6. City Attorney Askins read, AN ORDINANCE VACATING, ABANDONING <br />AND CLOSING THE STREETS AND ALLEYS LYING WITHIN A 96.242 ACRE <br />TRACT OF LAND OUT OF THE T.W.LEE SUBDIVISION OF A PORTION OF <br />THE RICHARD PEARSALL 1/3 LEAGUE A-625, HARRIS COUNTY, TEXAS; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br />A motion was made by Councilman Tomerlin to approve and adopt <br />Ordinance 1247 as read. <br />There was discussion by Council as to what streets and easements <br />would be left open in this tract. Councilwoman Cline ask to <br />• see the statements from the three utility companies which are <br />normally a part of the process of street and alley closings. <br />Askins stated this had been by passed in this case. Cline <br />stated she felt the City had a policy for street and alley <br />closings and she felt there should be no exceptions. <br />Councilman Tomerlin withdrew his motion to approve Ordinance <br />No. 1247. <br />Councilman Tomerlin made a motion to table any action on this <br />item until such time as the utility easements have been cleared <br />with H.L.&P., Enter and B-ell Telephone. The motion was second <br />by Councilman Kibodeaux. The motion carried 4 ayes and 0 nays. <br />Ayes: Councilman Tomerlin, Councilman Kibodeaux, Councilwoman <br />Cline, Councilman Simons <br />Nays: None <br />7. City Attorney Askins read, AN ORDINANCE CONFERRING UPON THE <br />CITY MANAGER GENERAL AUTHORITY TO CONTRACT FOR EXPENDITURES <br />WITHOUT FURTHER APPROVAL OF CITY COUNCIL FOR BUDGETED ITEMS <br />NOT EXCEEDING THREE THOUSAND DOLLARS ($3,000.00); AND PROVIDING <br />AN EFFECTIVE DATE. <br />Motion was made by Councilman Tomerlin to approve and adopt <br />Ordinance No. 1247 as read, second by Councilman Simons. The <br />• motion carried 2 ayes, 1 nay, 1 abstain. <br />Councilwoman Cline stated she voted nay to express her opposition <br />to the newly approved City Charter which confers this authority <br />by ordinance. <br />Mayor Meza Cast a vote Aye. <br />
