L_I <br /> <br />• Minutes, Regular Meeting, La Porte City Council <br />January 6, 1982, Page 4 <br />Meza: Is the Council aware that a certificate of occupancy <br />will not be issued until such time as there is either a work- <br />able septic tank or a sewer tap made into our sanitary sewer <br />line? <br />Skelton: Mr. Mayor, I have some questions of our City Inspector <br />and. Mr. Joerns, but after Mr. Barfield is finished. <br />Barfield: Sir, I understand there may be some question as to <br />the plans that were submitted not having a kitchen facility, <br />inasmuch as the ordinance requires that food must be served <br />before any beer may be sold for on-premises consumption. The <br />reason the facility has no kitchen facility located in the plan <br />as submitted, is that this is a barbecue facility and the pit <br />will be located outside. This matter has been discussed by my <br />client with your City people and. there will not be a flame <br />which would require fire code ordinances to be enforced within <br />the building. There will be food served. I have here a let- <br />ter from my client, again setting out in writing, not a verbal <br />affirmation to the Council, that there will be food served <br />• before any alcoholic beverage is sold on those premises. <br />Westergren: I have one more question. I am a little concerned <br />about the traffic problem there. Ts there anything your client <br />can do, or cannot do, in people leaving there and going directly <br />back out on 146? If you get enough traffic going in and out <br />of there, we already have a traffic problem at that intersection. <br />There have been a number of accidents at that intersection. <br />I understand you have a driveway that goes out on Fairmont Park- <br />way. That can only go one direction; it won't help much for <br />traffic going the other way. That is my only other apprehension. <br />Barfield: There is more property there than is needed to ser- <br />vice this one business, and that property location is not in- <br />tended solely for the use of Tooney's Restaurant. It is the <br />intention that in the future it be developed, in which case I <br />am sure both driveways would be used. <br />Longley: Mr. Barfield, I had some desire expressed to me that <br />Tooney's have a fence along the back of their property to screen <br />the residential area. I know that is not required, but are <br />there any plans for a fence? <br />Barfield: That is a possibility, but I know of no plans at this <br />time. I think we are going to have to do some serious negotia- <br />tions with our neighbors on both sides, especially when it <br />comes to the sewer tap. <br />• <br />
