• • <br />• Minutes, Joint Public Hearing and Regular Meeting <br />La Porte City Council, March 3, 1982 <br />Page 7 <br />Porter: Evidently, Mr. Askins hasn't read that whole con- <br />tract, because he can't sell that without my permission. <br />Nobody said a word to me; he just jumped up and took off <br />with it. <br />Askins: That is really not an issue in this zoning hearing, <br />but I have examined that deed and they have a general warranty <br />deed and an owner's title policy on the land. They owe you <br />a first lien note; you are a lien holder, but you are not an <br />owner. <br />Brieden: I was in Mr. Askins' office this morning and Mr. <br />Porter was supposed to be notified that we are ready to pay <br />off this lien and that will be all taken care of. <br />Porter: T haven't heard from anybody. <br />Meza: This is a zoning hearing, not a court to decide who <br />owns title to the property. Are there any further questions <br />from the Council? Mrs. Broadwater states she lives near the <br />property and she objects to it. Does the Council have any <br />further comment? <br />Simons: I am confused. Is he the legal owner? I understand <br />only the legal owner can apply for rezoning, <br />Askins: Mr. Simons, I stated a moment ago, T examined Mr. <br />Brieden's deed and title policy. He is the owner and Mr. <br />Porter is a lien holder. He holds a mortgage on the property <br />that I understand from Mr. Brieden he is going to pay off. <br />As the Mayor pointed out, that is not an issue in this zoning <br />hearing. <br />Porter: I'd like to see you just let the thing go until we <br />see who really does own it. I think I own it and T don't <br />want anything different until you get the thing cleared up. <br />Meza: Is there any further comment? Tf not, this Public <br />Hearing is closed and there will be a short recess while Plan- <br />ning and Zoning consider their recommendation to Council. <br />5. At 7:35 P.M. Mayor Meza reconvened the meeting by calling the <br />Regular Meeting of the La Porte City Council to order. <br />6. The City Council considered the minutes of the Regular Meeting <br />• of the La Porte City Council held February 17, 1982. <br />
