City Attorney Askins read: AN ORDINANCE DISANNEXING CERTAIN <br /> TERRITORY HERETOFORE ANNEXED TO THE CITY OF LA PORTE; CON.. <br /> TAINING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE OPEN <br /> MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF <br /> A motion was made by Councilperson Westergren to pass and <br /> approve Ordinance No. l350 as read by the City Attorney, <br /> disannexing the 75% of the pr.operty owned by Union Carbide <br /> Corporation, north of SH 225 and west of Strang Road. <br /> Second by Councilperson Skelton. The motion carried, 9 ayes <br /> and 0 nays. <br /> Ayes: Councilpersons Malone, Longley, Matuszak, Graves, <br /> . Pfeiffer, Gay, Skelton, Westergren and Mayor Cline <br /> Nays: None <br /> l7. Administrative Reports: <br /> City Mariager Owen requested an executive session on a <br /> personnel and legal matter. <br /> l8. Council Action: <br /> Councilperson Malone requested an executive session on a <br /> legal question. Malone discussed the complaints he has <br /> received concerning a modular home moved into the Coupland <br /> Drive subdivision. He asked if there was anything that <br /> could be done to prevent this kind of thing from happening <br /> again. City Attorney Askins stated the State of Texas over- <br /> rode cities and passed legislation permitting modular homes <br /> to be placed where they meet the square footage requirement <br /> and are not prohibited by deed restrictions. Deed restric- <br /> tions still could be drawn for the Diamond "c" subdivision <br /> and they would be binding on all properties whose owners <br /> sign but not on the properties whose owners do not sign. <br /> Councilperson Longley extended safe and happy holiday wishes. <br /> Councilperson Matuszak wished Merry Christmas to all. <br /> . <br />
