Mr. Ernie Ganem appeared before Council to discuss the repair of his place of business after a fire on January 22, 1983. The Council listened to Mr: Ganem's presentation. He was requesting permission to reopen his business without rewiring first and without a 2-hour fire wall. City At- torney Askins advised Council it was not within their juris- diction at this time to waive code provisions or to over- ride the action taken by the Building Inspector, and that the Building Inspector was acting properly to enforce the building codes of the City of La Porte. 7. Council considered authorizing the City Manager to enter into negotiations with H.M.S., Tnc., fora data processing contract and appropriated funds. A motion was made by Councilperson Matuszak authorizing the City Manager to negotiate a contract with H.M.S., Tnc., for data processin equipment and a pro- priating 56,350.00 rom the Genera Fund Contingency. Second by Councilperson Westergren. The motion carried, 6 ayes and 1 nay. • Ayes: Councilpersons Longley, Matuszak, Graves, .Skelton, Westergren and Mayor Cline Nays: Councilperson Malone 8. City Attorney Askins read: AN ORDINANCE REPEALING CHAPTER 25, ARTICLE 4, SECTION 25-6Q, OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
