Mr. Ernie Ganem appeared before Council to discuss the <br />repair of his place of business after a fire on January 22, <br />1983. The Council listened to Mr: Ganem's presentation. <br />He was requesting permission to reopen his business without <br />rewiring first and without a 2-hour fire wall. City At- <br />torney Askins advised Council it was not within their juris- <br />diction at this time to waive code provisions or to over- <br />ride the action taken by the Building Inspector, and that <br />the Building Inspector was acting properly to enforce the <br />building codes of the City of La Porte. <br />7. Council considered authorizing the City Manager to enter into <br />negotiations with H.M.S., Tnc., fora data processing contract <br />and appropriated funds. A motion was made by Councilperson <br />Matuszak authorizing the City Manager to negotiate a contract <br />with H.M.S., Tnc., for data processin equipment and a pro- <br />priating 56,350.00 rom the Genera Fund Contingency. <br />Second by Councilperson Westergren. The motion carried, 6 <br />ayes and 1 nay. <br />• Ayes: Councilpersons Longley, Matuszak, Graves, .Skelton, <br />Westergren and Mayor Cline <br />Nays: Councilperson Malone <br />8. City Attorney Askins read: AN ORDINANCE REPEALING CHAPTER <br />25, ARTICLE 4, SECTION 25-6Q, OF THE CODE OF ORDINANCES OF <br />THE CITY OF LA PORTE; PROVIDING THAT ANY PERSON VIOLATING <br />THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM <br />NOT MORE THAN TWO HUNDRED DOLLARS ($200.00) AND EACH DAY <br />OF VIOLATION SHALL BE DEEMED A SEPARATE OFFENSE; CONTAINING <br />A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />A motion was made by Councilperson Skelton to approve and <br />adopt Ordinance No. 135 as read by the City Attorney. <br />Secon y Counci person Graves. T e motion carried, 7 ayes <br />and 0 nays. <br />Ayes: Councilpersons Malone, Longley, Matuszak, Graves, <br />Skelton, Westergren and Mayor Cline <br />Nays: None <br />9. City Attorney Askins read: AN ORDINANCE GRANTING A PERMIT <br />UNDER SECTION 18-A-3 OF ORDINANCE NO. 915, "PIPELINE ~TRANS- <br />PORTATTON," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF <br />THE CITY OF LA PORTE, TEXAS; AND APPROVING THE APPLICATION <br />OF ENTERPRISE PRODUCTS COMPANY, TO EXTEND TWO SIX-INCH (6") <br />
