Minutes, Public Hearing and Regular Meeting <br />• La Porte City Council <br />February 15, 1984, Page 2 <br />4. Mayor Pro Tem Westergren proclaimed La Porte Go Texas Week <br />and presented the proclamation to Al Blackford. <br />5. Mayor Pro Tem Westergren proclaimed Future Business Leaders <br />of America-Phi Beta. Lambda Week. <br />6. The public hearing on rezoning of La Porte Outlots 18, 19, 20, <br />21 and-22 from residential to commercial was postponed due <br />to a legal technicality. <br />Councilperson Graves arrived at the Council table at 7:09 P.M. <br />7. Council considered an .ordinance updating Texas Municipal Re- <br />tirement System Buy-Back provision. <br />City Attorney Askins read: AN ORDINANCE ALLOWING CERTAIN <br />EMPLOYEES OF THE CITY WHO HAVE TERMINATED. PREVIOUS MEMBER- <br />SHIPS IN TEXAS MUNICIPAL RETIREMENT: SYSTEM, TO DEPOSIT THE <br />SUMS SO WITHDRAWN, PLUS ANNUAL WITHDRAWAL CHARGES, AND AL- <br />LOWING AND UNDERTAKING THE COST OF ALLOWING ANY SUCH EMPLOYEE <br />CREDIT IN SUCH SYSTEM FOR ALL SERVICE TO WHICH SUCH EMPLOYEE <br />• HAD BEEN ENTITLED AT DATE OF SUCH WITHDRAWAL, WITH LIKE EF- <br />FECT AS IF ALL SUCH SERVICE HAD BEEN PERFORMED AS AN EMPLOYEE <br />OF THIS CITY. <br />Motion was made by Councilperson Malone to adopt Ordinance 1399 <br />as read by the City Attorney. Second by Councilperson Graves. <br />The motion carried, 8 ayes and 0 nays. <br />Ayes: Councilpersons Longley, Matuszak, Graves, Pfeiffer, Gay, <br />Skelton, Malone and Mayor Pro Tem Westergren <br />Nays: None <br />8. Council considered an agreement with Kay Homes for sewer service <br />in Brookglen Section III. <br />City Manager Owen requested this item be held until the end of <br />the meeting-and an executive session on legal matters be held <br />at that time. Councilperson Skelton also requested an execu- <br />tive session on this item. <br />9. Council considered adopting an ordinance establishing a sanitary <br />sewer capital recovery fee in the area annexed. to the-City of <br />La Porte by Ordinance 1393. <br />Motion. was made b Council erson Gay to table this item for <br />• further consideration. Secon y Counci person Long ey. The <br />motion carried, 7 ayes and l nay. <br />
