City Attorney Askins read two ordinances dealing with on- <br />premise consumption of beer at 2199 Underwood Road. The <br />two ordinances shall be tagged "J-2" and "J-5" for identi- <br />fication purposes. The differences in the two ordinances <br />being Section l, (4), concerning required audits. J-2 would <br />provide that the Building Official, upon receiving a complaint <br />could require a verified audit showing gross income from <br />alcoholic beverages and from the sale of food, not to exceed <br />two au~its a year. J-5 states the ~icensee shall furnish <br />the City Secretary with a verified audit within 45 days of <br />the close of the calendar year showing the gross income re-.., <br />ceived from the sale of alcoholic beverages and from the sale <br />of food. <br /> <br />A motion was made to approve Ordinance J-5 by Councilperson <br />Matuszak. Second by Councilperson Malone. The motion car- <br />ried, 8 ayes and I nay. <br /> <br />Ayes: Councilpersons Malone, Longley, Graves, Pfeiffer, Gay, <br />Skelton, Westergren and Mayor Cline <br />,;Nays: Councilperson Matuszak <br /> <br />City Attorney Askins read: AN ORDINANCE AMENDING ORDINANCE <br />NO. llOO OF THE CITY OF LA PORTE, TEXAS, DESIGNATING THE <br />AREAS WHERE BEER FOR CONSUMPTION ON THE PREMISES MAY BE SOLD <br />AND PROHIBITING THE SALE ELSEWHERE; PROVIDING FOR HOURS OF <br />OPENING AND CLOSING: PROVIDING SALE OF BEER FOR CONSUMPTION <br />OFF PREMISES SHALL NOT BE AFFECTED; DEFINING SOURCE OF AUTH- <br />ORITY; PROVIDING THAT NO LICENSE SHALL BE ISSUED EXCEPT FOR <br />THE AREAS HEREIN DESIGNATED; DEFINING RESTAURANT; GRANTING <br />A PERMIT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF <br /> <br />A motion was made by Councilperson Pfeiffer to approve and <br />adopt Ordinance No. IOOO-p as read by the City Attorney, <br />granting an on premise beer permit to Sweet Pea's Po Boy and <br />Sandwich Shoppe at 2199 Underwood Road. Second by Council- <br />person Gay.
