<br />• <br />• <br />Minutes, Regular Meeting, La Porte City Council <br />July 18, 1984, Page 6 <br />Mr. Matuszak asked if the Carter Trust had formally requested <br />in writing, for the City to restore the property. The City <br />Attorney replied that although it had not been explicitly re- <br />quested, there had been quite a good bit of exchange of corres- <br />pondence between the City and Carter Trust attorneys that could <br />legally be regarded as a formal request. <br />Councilperson Matuszak asked if the contract should have the <br />City of La Porte called "owner" since they are not the owners. <br />Mr. Askins replied that normally the contracting party or the <br />paying party is called the owner in contracts of this type. <br />Councilperson Matuszak asked why there was a difference in <br />engineering fees in this project and the street paving project. <br />It was explained that charges are done on a curve - the lower <br />the cost, the higher the fee. <br /> <br />Councilperson Skelton asked if we could get the City to where <br />we would not be obligated for any liability after the work is <br />done and the release is signed if at some time in the future <br />the property is sold. City Attorney Askins said that we will <br />get a full and final release covering every type of claim and <br />be binding on the owner and his asignees. The next stage of <br />the work will be for the City Engineer to certify to the City <br />and to the Carter Trust the plans and specs. At that point <br />we will sign a release before them. <br />Mayor Cline questioned whether or not a price had been set on <br />the purchase of the land. Mr. Hodge replied that he thougk~t <br />it was around $300,000. <br />Motion was made by Councilperson Gay to~approve the contract <br />with Carlos Smith for en ineering services for the restoration <br />of the Carter Trust property. Second by Councilperson Wester- <br />gren. The motion carried, 7 ayes, 0 nays and 1 abstain. <br />• <br />Ayes: Skelton, Westergren, Longley, Matuszak, Graves, Gay <br />and Mayor Cline <br />Nays: None <br />Abstain: Councilperson Malone <br />16. Council considered awarding an annual contract for street <br />materials. <br />Purchasing Agent Jackson Ray stated that the recommendations <br />are all low bid meeting specs, and asked for a contingency <br />contract to the second low bidder. <br />Mr. Gay inquired where the funds were budgeted, and was in- <br />formed they are budgeted in the streets or maintenance depart- <br />ments . <br /> <br />
