Minutes, Public Hearing and Regular Meeting <br /> La Porte City Council <br /> December 19, 1984, Page 8 <br /> Councilperson Matuszak expressed concern regarding the <br /> rezoning in the matter of the ordinance not being more <br /> specific in the restrictions of use of the property and no <br /> provisions made for a green belt area. City Attorney Askins <br /> stated that normally the wording of the ordinance would <br /> include the restrictive language, but that his assistant had <br /> ~repared the ordinance and he (Askins) had not caught the <br /> omission. As far as the beautification is concerned, there is <br /> really nothing we can do legally until the Master Plan is <br /> adopted. <br /> Councilperson Skelton questioned section 9 of the ordinance, <br /> which is the section pertaining to notifying the applicant of <br /> the rezoning classification and advising him of the <br /> possibility that the property might be under a different <br /> classification when the Comprehensive Plan is adopted. <br /> The City Attorney explained that this was put in the ordinance <br /> in order that an applicant be aware that his rezoning would <br />. not be "grand fathered" when the Comprehensive Plan is adopted <br /> and that he might possibly have to apply for another rezoning <br /> if his property did not fit the classification in the <br /> Comprehensive Plan. <br /> Councilperson Waters asked if Mr. DeBlanc was aware that if <br /> restrictive language is put into the ordinance, that he would <br /> have to go through the whole rezoning process again if he sold <br /> the property to someone other than his proposed buyer. Mr. <br /> DeBlanc indicated he did understand this and it was agreeable <br /> with him. <br /> Councilperson Malone expressed concern that Council would <br /> rezone a piece of property when the people on Spencer Highway <br /> already have businesses established and had appeared before <br /> Council to get something done about rezoning them, and so far <br /> had no satisfaction. The City Attorney explained that this <br /> was an annexed area and that the whole area would have to be <br /> rezoned at one time, and he is working with Planning and <br /> Zoning to get this accomplished. <br />. <br />~ ~ <br />
