M. Jones Survey, <br />Abstract 482 (Meets and Bounds description <br />attached, see Exhibit A)i Located at 9800/ <br />9900 Block of West Fairmont Parkway. <br /> <br />The changes in zoning on property in the area of the request and <br />the resulting development of the property with Recreational <br />Vehicle and "Boat Storage facilities along with the service station <br />~nd car wash have realistically cut the two (2) tracts under <br />consideration off from the remaining R-3 zoned land. Previous <br />rezonings and sales by the landowner have created a boundary <br />condition of R-3 against N.C. on three (3) sides. This situation <br />may make it more difficul t to develop as a R-3. High Density <br />Residential Project. <br /> <br />On Septembe r 6, 1988, Mr. Ca rl Fe rguson , Pres ident of the <br />Home Owners Association. forwarded to the City Secretary, a <br />petitiQn in opposition to the Zone Change Request. Staff is <br />rev iewing the peti t ion to dete rmine if it conta ins suffic ient <br />signatures to require a 3/4 vote of the City Council to approve of <br />the request as stipulated in Section 1-507.7 of our Zoning <br />Ordinance. <br /> <br />Staff does feel there is sufficient information to warrant <br />consideration for a change in zoning classification. <br /> <br />Recommendation: <br /> <br />The Planning and Zoning Commission recommends approval of the <br />reque~t for Neighborhood Commercial (N.C.) zoning on the 6.5279 <br />acre tract. <br /> <br />Action Required bY Council: <br /> <br />1. Approve the request (depending on validation of petition may <br />require affirmative vote of seven (7) members of the City <br />Council). <br />2. Deny the request. <br />3.
