Executive Session - V.A.T.S. - Article 6252-17, Section 2 (E), <br />(F), (G), (R) - (Legal, Land Acquisition, Personnel and <br />Conference(s) with City Employee(s) to Receive Information) <br />Discussion with Attorney regarding Houston Chemical Services, <br />Inc. <br />2. Consider ordinance establishing hazardous waste incinerator <br />siting requirements. <br />Council adjourned into executive session at 6:57 P.M. and <br />returned to the Council table at 8:23 P.M. <br />Council considered an ordinance establishing hazardous waste <br />incinerator siting requirements. <br />The City Attorney read: ORDINANCE 1634 - AN ORDINANCE <br />ESTABLISHING HAZARDOUS WASTE INCINERATOR SITING REQUIREMENTS; <br />PROVIDING ANY PERSON, FIRM OR CORPORATION WHO VIOLATES ANY <br />PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDEMEANOR, AND UPON CONVICTION SHALL BE FINED NOT MORE THAN <br />$200.00; PROVIDING CIVIL REMEDIES, PROVIDING FOR CONFLICT WITH <br />OTHER LAWS AND ORDINANCES; PROVIDING A SAVINGS CLAUSE; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING THAT THIS <br />ORDINANCE SHALL BE EFFECTIVE UPON ITS PASSAGE, APPROVAL, AND <br />PUBLICATION OF ITS CAPTION AS REQUIRED BY LAW. <br />Brent Ryan, Special Counsel for the City, pointed out several <br />revisions to the original draft of the ordinance in Section 2 <br />A.(2) and 2 A.(3). Part of the first sentence in each of <br />those sections was changed to read: "No hazardous waste <br />incinerator facility which accepts for treatment, storage, or <br />disposal, hazardous waste generated off -site and which has..." <br />Councilperson Waters made the recommendation that thirty <br />million BTU per hour in Section 2 A.(2) be changed to fifty <br />million BTU per hour and the distance be changed from three <br />thousand feet to six thousand feet; and in Section 2 A.(3) <br />that one hundred million BTU per hour be changed to <br />seventy-five million BTU per hour and the distance be changed <br />from one mile to ten thousand feet. <br />
