Mr. Neil Woodard addressed Council regarding the Myrtle Creek <br />traffic problem. <br /> <br />7. The Mayor called to order the public hearing on the request <br />of William S. Davis for a Special Conditional Use permit to <br />allow raising and breeding of emus. <br /> <br />Joel Albrecht, Director of Community Development, reviewed the <br />request for Council. <br /> <br />The Mayor read three letters received in opposition to the <br />request. <br /> <br />Mr. William Davis, requestor, addressed Council in favor of <br />the request, and answered questions from Council regarding the <br />raising and breeding of emus and what is required to do so. <br /> <br />Mr. A. C. Wandell and Ms. Mary Lamb addressed Council in <br />opposition to the request. <br /> <br />The Mayor asked for further public input. There being none, <br />the public hearing was closed. <br /> <br />8. Council considered granting a Special Conditional Use Permit <br />to william S. Davis, DBA Ratite Ranch, to allow raising and <br />breeding of emus. <br /> <br />Motion was made bv Councilperson Porter to deny the Special <br />Conditional Use permit to William S. Davis for the raisina and <br />breeding of emus. Second by Councilperson McLaughlin. The <br />motion carried, 7 ayes and 0 nays. <br /> <br />Nays: <br /> <br />Councilpersons Waters, Cooper, McLaughlin, Porter, <br />Gay, Clarke and Mayor Malone <br />None <br /> <br />Ayes: <br /> <br />9. Council considered an ordinance setting the FY 1989-90 tax <br />rate. Finance Director Jeff Litchfield reviewed the ordinance <br />for Council. <br /> <br />The City Attorney read: ORDINANCE 1669 - AN ORDINANCE LEVYING <br />TAXES UPON TAXABLE PROPERTY LOCATED WITHIN AND SUBJECT TO <br />TAXATION IN THE CITY OF LA PORTE, TEXAS; MAKING APPROPRIATIONS <br />FOR SUPPORT, MAINTENANCE, AND IMPROVEMENT OF THE CITY <br />GOVERNMENT OF SAID CITY OF LA PORTE; FINDING THAT ALL REQUIRED <br />NOTICES HAVE BEEN PUBLISHED AND ALL REQUIRED HEARINGS HELD; <br />CONTAINING A REPEALING CLAUSE; CONTAINING A SEVERABILITY <br />CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br />
