Council considered approving a utility extension across <br />Underwood Road to serve a 9.26 acre tract of land in Deer <br />Park, Texas. <br /> <br />Motion was made bY Councilperson Porter to approve the utility <br />extension across Underwood Road. Second by Councilperson <br />Matuszak. <br /> <br />During discussion, it was brought out that several businesses <br />in the location involved had tied into the existing four-inch <br />sewer line without permission from the city. This has caused <br />an overload on the existing line. Another business wishes to <br />tie in to the overloaded line. A six-inch line would <br />alleviate the problem. Several Councilpersons felt that since <br />there are citizens in La Porte who still do not have sewer <br />service, and since the businesses are located in Deer Park, <br />the problem needs to be addressed by Deer Park. <br /> <br />Councilperson Matuszak withdrew his second to the motion to <br />approve, and councilperson Porter withdrew his motion. <br /> <br />Motion was made by Councilperson McLauqhlin to deny the <br />utility extension across Underwood Road. Second by <br />Councilperson Skelton. The motion carried, 8 ayes and 0 nays. <br /> <br />Nays: <br /> <br />Councilpersons Waters, Cooper, Matuszak, McLaughlin, <br />Porter, Skelton, Clarke and Mayor Malone <br />None <br /> <br />Ayes: <br /> <br />24. Council considered approving a refund paYment to Alpha <br />Chemical, Inc., for overpaYment of taxes. <br /> <br />Motion was made bY Councilperson Skelton to aQProve the refund <br />to Alpha Chemical. Second by Councilperson Cooper. The <br />motion carried, 7 ayes and 0 nays (Councilperson Porter was <br />away from the table). <br /> <br />Nays: <br /> <br />Councilpersons Waters, Cooper, Matuszak, McLaughlin, <br />Skelton, Clarke and Mayor Malone <br />None <br /> <br />Ayes: <br /> <br />25. Council considered approving a professional engineering <br />services agreement for design of a 12-inch water line on <br />Spencer Highway. <br /> <br />Motion was made by Councilperson Waters to award the <br />professional services agreement for design of a 12-inch water <br />line on Spencer Highway to H. Carlos Smith. in an amount not <br />to exceed $26.200. Second by Councilperson Skelton. The <br />
