<br /> <br />• <br />WHEREAS, the citizens of San Antonio have expressed concern about <br />dogs that run loose, that bite or attack, and about owners who do <br />not obey the City's leash law; and <br />WHEREAS, as the city's population grows and becomes more dense <br />the need for better controls, reasonable restraints and improved <br />dog ordinances becomes apparent; and <br />WHEREAS, most experts believe that the problems of dog bites and <br />attacks, and dog over-population can only be solved when dog <br />owners become responsible for the care and control of their <br />animals; and <br />WHEREAS, those citizens who choose to own, train or keep <br />aggressive dogs, and those who have and own attack dogs, or known <br />biters, and those not safe to be around the play of children, <br />have an added responsibility, and <br />WHEREAS, the purpose of this ordinance is not to make it an <br />offense to own a dog; but rather the offense is the reckless <br />management and control of the dog; and <br />WHEREAS, it is the opinion of this City Council that it is <br />necessary for the protection of the public health, safety and <br />welfare of the citizenry to regulate vicious dogs; NOW <br />THEREFORE: <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ANTONIO: <br />SECTION 1. That Chapter 5 of the City Code of the City of San <br />Antonio, as amended, is amended by adding Sec. 5-146 through Sec. <br />5-153 to be entitled "Vicious Dogs" to be comprised of <br />appropriate sections to read as follows: <br />Sec. 5-146 DEFINITIONS: as used in Sections 146 through 153 <br />inclusive, of this Chapter, the following words or terms shall <br />have the following meanings, unless the context shall indicate <br />another or different meaning or intent. <br />1. "Vicious Dog" means: <br />(a) any dog that, when unprovoked, inflicts severe injury <br />or death to a person, or bites a person on public or <br />private property; or <br />(b) any dog that has killed a domestic animal without <br />provocation while off the owner's property; or <br />(c) .any dog which, when unprovoked, chases or approaches a <br />person upon the streets, sidewalks, or any public or <br />private property in a menacing fashion or apparent <br />attitude of attack such that the person reasonably <br />believes that the dog will cause physical injury to <br />that person; or <br />-2- <br />
