<br />5~ <br />CJ <br />(d) any individual dog with a known propensity, tendency or <br />disposition to attack unprovoked, to cause injury, or <br />to otherwise threaten the safety of persons or domestic <br />animals. <br />2. "Animal Control Official" means any employee in the animal <br />control division of the Health Department or any individual <br />designated by the Director of the Health Department to <br />enforce the provision of this section. The Animal Control <br />Official must be certified by the State of Texas as an <br />Animal Control Officer or be a licensed veterinarian. <br />3. "Determination Hearing Officer" means any Health Department <br />employee or any individual designated by the Director of the <br />Health Department. The hearing officer shall have a working <br />knowledge of animal behavior. <br />4. "Enclosure" means a house or a building, or in the case of a <br />fence or a structure/pen, the fence or structure/pen must b~ <br />at least six (6) feet in height. The structure/pen must <br />also have minimum dimensions of five (5) feet by ten (10) <br />feet. The fence or structure/pen must form an enclosure <br />suitable to prevent entry of young children, and must be <br />locked and secured such that a dog cannot climb, dig, jump <br />or otherwise escape of its own volition. The enclosure <br />shall be securely locked at all times. The structure/pen <br />must have secure sides to prevent the vicious dog from <br />escaping from the enclosure. The structure/pen shall <br />provide protection from the elements for the vicious dog. <br />Notwithstanding the fence height restrictions of Chapter 6, <br />Sec. 2 of this Code, the Animal Control Official shall have <br />the right to require that the fence be higher than six (6) <br />feet or require a secure top and/or a secure bottom be added <br />to the structure/pen if the need is demonstrated. This <br />additional requirement shall be based upon the type of dog <br />to be kept in the enclosure and its anticipated ability to <br />escape. <br />5. "Menacing fashion" means the show by a dog of a disposition, <br />determination, or intent to attack or inflict injury or harm <br />to a person. <br />6. "Owner/Keeper" means any person, firm, corporation, <br />organization or department possessing, harboring, keeping, <br />holding, caring for, having an interest in, or having <br />control or custody of a dog. If the owner/keeper of a dog <br />is a minor, the parent or guardian of that minor shall be <br />responsible for compliance with specifications of the <br />ordinance. <br />-3- <br />
