HICKENBOTTOM ~,~~~~ <br />SUBJECT: SMOKE DETECTOR ORDINANCE 1093-B <br />This memo is in regards to the repeal of the currently <br />adopted Smoke Detector Ordinance 1093-B (SEE COPY ATTACHED), and <br />the adoption of anew Ordinance (SEE COPY ATTACHED), that adopts <br />the provisions of Chapter 92, Texas Property Code, relating to <br />Smoke Detectors in residential dwelling units. <br />According to City Attorney Knox Askins, after his review of <br />Ordinance 1093-B, and H.B. 2046, (which is now part of Chapter <br />92), it was his recommendation that Ordinance 1093-B be repealed <br />and the provisions of Chapter 92 be adopted. <br />It is my opinion that with the repeal of 1093-B, the City <br />could save approximately $500.00 a year because: <br />1. Affidavit files will no longer have to be maintained. <br />2. Registered mail will no longer have to be sent out. <br />Also, it will clear up conflicts with the State law. <br />It is also my opinion, that with the adoption of the <br />provisions of Chapter 92, it will: <br />1. Provide a more complete Smoke Detector program for the <br />City, ie: All rental property. <br />2. Clear up any conflicts with the State law,ie: maintenance <br />3. Reduce the yearly operating cost of large apartment <br />projects. <br />Therefore, I request permission to pursue this matter. <br />
