Box 1115 <br />LaPorte, Texas 77571 <br /> <br />Re: City Ordinance # 1784 <br /> <br />Dear Council Members: <br /> <br />On October 28, 1991, I made a personal appeal to the City Council <br />to see if my hunting rights on 300 acres of land could be <br />grand fathered under the amended City Ordinance 1784, since <br />hunting on the land did not pose any threat to Public Health or <br />Safety. Obviously the issues that I raised did not warrant <br />further consideration by the Council and therefore I must <br />reconnoiter all of the options available to me under the Law. <br />In my letter to the City I also addressed the fact that the City <br />had no intention of keeping their promise to the landowners 18 <br />years ago, that if the landowners did not oppose annexation, the <br />City would reciprocate by providing utilities to the tract. I <br />have since recommended to the landowners that they pursue <br />Deannexation from the City of LaPorte, since the City is not <br />providing any services to the landowners for the City Taxes that <br />have been paid over the past 18 years. <br />The City Council amended an ordinance at the request of one small <br />taxpayer, to the detriment of several large taxpayers and at <br />considerable expense to me personally. The City Councils' action <br />constitutes a " Taking " and therefore the City should compensate <br />me for my financial loss, that resulted from your actions. <br />I enclose herewith a UNITED STATES SUPREME COURT LANDMARK TAKINGS <br />OPINION, for your legal counsel to review. <br />Since the ordinance only speaks to " game animals as defined by <br />the Texas Parks and Wildlife Code "I assume that by the City <br />Councils' lack of response to my stocking the property with <br />Mouflon Rams, Barbadoau Sheep and other non "game animals" that <br />it is acceptable for me to do so and therefore I will. <br /> <br />Respectfully yours, <br /> <br />iti!~ /l:~ <br />
