Council considered an ordinance declaring the intention of the <br />City of La Porte to institute proceedings to annex certain <br />territory; calling two public hearings at which all interested <br />parties shall have an opportunity to be heard; providing for <br />the publication of notice of such hearing by the publication <br />of this ordinance. <br /> <br />city Attorney Knox Askins stated Council should have received <br />a report from city Manager Bob Herrera's office prepared by <br />Carol Butler. In summary that report shows positive responses <br />received from most of the 48 industries. The purpose of this <br />ordinance is to maintain a time schedule that an annexation <br />must be completed during calendar year 1993, to do so it must <br />be started at this time. This is not a final annexation <br />ordinance, it is an intent ordinance that starts an annexation <br />proceeding. The ordinance describes all of Bayport and <br />Battleground and will be cut down to include only those <br />industries who do not elect to sign the industrial district <br />agreement. Never-the-Iess, it does start out with a complete <br />description of both Bayport and Battleground Industrial <br />Districts. In order to be in compliance with state law, the <br />publication of this ordinance will be in the Bayshore Sun this <br />Sunday November 14 and the two public hearings will be held on <br />Monday, November 29 and Tuesday, November 30 and the final <br />annexation, if necessary, will be held in late December. <br /> <br />Councilperson Sutherland stated he will be out of town on the <br />two public hearing dates. The remaining Council were polled <br />and all other stated they will be available for the two <br />meetings. <br /> <br />City Attorney read: ORDINANCE 93-1946 AN ORDINANCE <br />DECLARING THE INTENTION OF THE CITY OF LA PORTE TO INSTITUTE <br />PROCEEDINGS TO ANNEX CERTAIN TERRITORY; CALLING TWO PUBLIC <br />HEARINGS AT WHICH ALL INTERESTED PARTIES SHALL HAVE AN <br />OPPORTUNITY TO BE HEARD; PROVIDING FOR THE PUBLICATION OF <br />NOTICE OF SUCH HEARINGS BY THE PUBLICATION OF THIS ORDINANCE; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING <br />AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made bv CouncilDerson Maxwell to adoDt ordinance <br />93-1946. Second by councilperson Clarke. The motion carried, <br />9 ayes and 0 nays. <br /> <br />Councilperson Porter commented on the Quantum Corporation <br />request and said because of the "most favored nations clause" <br />the ci ty is prohibi ted from taking exception to anyone <br />request. He wanted to point that out to those who might not <br />
