<br />Agreement with Harris County - Sylvan Beach Fishing Pier
<br />
<br />As per your request, I have reviewed the proposed agreement with Harris County in reference
<br />to the leasing by the City of La Porte of the fishing pier located at Sylvan Beach Park. I found
<br />no major differences, other than the agreed-to changes negotiated by yourself and Mr. Louis
<br />Ditta of Harris County, Precinct 2, and the previous drafts of the agreement.
<br />
<br />The agreement is for a period of thirty-two (32) years beginning upon execution of the
<br />agreement by the governing bodies of both parties and ending on March 31, 2026. The County
<br />agrees to furnish plans and specifications, which the City agrees to modify to comply with all
<br />applicable laws and regulations, and to furnish all of the materials required to reconstruct the
<br />pier using the existing pilings. The City agrees to provide the funding for a contractor to rebuild
<br />the pier, modify the plans and specifications, establish an escrow account using the funds
<br />collected for use of the pier by the public to be used to rebuild the pier if it is damaged or
<br />destroyed by natural disaster, maintain the pier, establish a fee for use of the pier not to exceed
<br />$5.00 per person unless authorized by the County, and to rebate to the County 1/3 of the gross
<br />annual receipts of the pier, provided the escrow account is maintained at the agreed $60,000.00
<br />equivalent amount (adjusted for inflation annually). The County receives no funds until the
<br />escrow account is the equivalent of $60,000,00.

<br />Staff recommends the approval of the agreement between Harris County and the City of La
<br />Porte for the lease of the Sylvan Beach Fishing Pier. Should you have any questions or desire
