City of La Porte <br />Established 1892 <br />February 22, 1995 <br />Fairmont Park East Homeowner's Association <br />10911 Linwood Ct. <br />LaPorte, Texas 77571 <br />Subject: Letter of Agreement <br />Gentlemen: <br />This letter of agreement outlines the responsibilities assumed by the City of La Porte, Texas and the Fairmont Park East <br />Homeowner's Association as they relate to the proposed construction of a basketball court on the Fairmont Park East <br />Community Center property. <br />In accordance with a Lease Agreement between the City of La Porte and the Fairmont Park East Homeowner's Association, <br />executed May 9, 1983, the Homeowner's Association is currently in the eleventh year of a forty year lease. The property <br />upon which the basketball court is to be constructed is City of La Porte property and at the end of the lease (April 1, 2023) <br />the control of the property will revert back to the City of La Porte. <br />The Homeowner's Association has reviewed the plans for this project (CLP #94-5204) and the change order by letter dated <br />February 10, 1995 and has approved same. The City of La Porte will inspect the construction of the proposed basketball <br />court at the Fairmont Park East Community Center to assure that the terms of the contract are adhered to and that the <br />structure is built according to specifications. The Homeowner's Association will accept sole responsibility for funding of <br />the project. After acceptance by the City, any maintenance or upkeep required of the structure shall be the sole <br />responsibility of the Homeowner's Association, until such time as the lease agreement expires. Upon approval, by <br />signature, of the elected president of the Fairmont Park East Homeowner's Association and the deposit of the necessary <br />funding for the project, the City will proceed with the adminstrad a requirements to implement the construction contract. <br />Thank you in advance for your prompt consideration. <br />Sinc el <br />ep e , Director <br />La orte Parks &Recreation Department <br />APPROVED: <br />Robert T.
