0 • <br />SECTION 3. BUILDING AND STANDARDS COMMISSION DRAFT <br />Section 3.01. Commission created. <br />The building and standards Commission of the city is hereby created. The <br />Commission shall function pursuant to subchapter C of chapter 54 of the Texas Local <br />Government Article for the purpose of hearing and determining cases concerning <br />alleged violations of ordinances relating to dangerously damaged or deteriorated <br />buildings or improvements, or conditions caused by accumulations of refuse, <br />vegetation, or other matter that creates breeding and living places for insects and <br />rodents. <br />Section 3.02. Members; terms. <br />(a) The Commission shall consist of five (5) regular and two (2) alternate <br />members who shall be appointed by the mayor and confirmed by the city council. <br />Members of the Zoning Board of Adjustment may be appointed to serve on the <br />Commission concurrently with their terms on the Zoning Board of Adjustment. <br />(b) Each member shall serve for a term of three (3) years and shall hold over <br />until the member's successor is qualified. Each regular Commission position shall be <br />numbered consecutively as positions One through Five,- and each altemate position <br />shall be numbered consecutively as positions One through Two. The members of each <br />panel, regular and alternate, shall be appointed to a specific numbered position. The <br />initial terms of each position shall begin on the first day of June, 2000, with the initial <br />terms of even numbered positions ending on the last day of May three years following, <br />and the terms of odd -numbered positions ending on the last day of May two years <br />following. <br />(c) A member may be removed as provided in Section 54.033(c) of the Texas <br />Local Government Article. <br />(d) A vacancy in any position shall be filled for the remainder of the unexpired <br />tern. <br />(e) A quorum of a Commission panel consists of four (4) members, and no <br />case before a panel shall be heard by fewer than four (4) members. Alternate members <br />shall serve in the absence of regular members when requested to do so by the mayor. <br />The concurrence of four (4) members of each Commission panel is required for the <br />issuance of an order of the Commission panel. <br />(f) The Commission shall elect a chairman and vice chairman at its first <br />meeting of each calendar year, and may reconvene from time to time to remove or <br />replace officers by majority vote of the regular and alternate members of the <br />Commission. <br />Page 1 <br />
