• 0 <br />Section 3.03. Hearings. <br />(a) The city attorney shall review for legal form and substance and the <br />Commission shall adopt rules in accordance with this Article for the conduct of the <br />meetings of the Commission, and of any hearings, re -hearings and other proceedings. <br />The rules shall be consistent with applicable law, this Article and the duties of the <br />Commission. Without limitation, the rules shall ensure that persons required to appear <br />before a Commission panel receive notice as provided by law, have the right to legal <br />counsel (although legal counsel shall not be required) and have the right to present <br />evidence and cross-examine witnesses presented against them. <br />(b) All cases before the Commission shall be presented by the Director of <br />Planning of the City, or his designee. <br />(c) The Planning Director or his designee shall designate a city employee <br />who shall function as the recording secretary, maintain the office of the Commission <br />and keep the minutes, records and files of the Commission panels as required by law. <br />(d) Meetings of the Commission shall be held at the call of the chairman and <br />at other times as determined by the Commission. All meetings shall be open to the <br />public to the extent required by Chapter 551 of the Texas Government Article. <br />(e) The chairman, or in the chairman's absence, each acting chairman, may <br />administer oaths and issue subpoenas to compel the attendance of witnesses. Any <br />request for a subpoena shall be in writing and state the purpose for and relevancy of <br />the intended witness and any documents requested. Requests for subpoenas may be <br />denied by each chairman or acting chairman for valid cause noted upon the minutes of <br />the Commission. <br />(f) Notice of all proceedings before the Commission shall be given by mail, <br />posting and publication as provided by Section 54.035 of the Texas Local Government <br />Article. <br />(g) The Commission shall have full authority to issue orders as provided in <br />Section 54.036 of the Texas Local Government Article relating to alleged violations of <br />ordinances relating to dangerously damaged or deteriorated buildings or improvements, <br />or conditions caused by accumulations of refuse, vegetation, or other matter that <br />creates breeding and living places for insects and rodents. <br />(h) No testimony or other evidence provided by any person in a hearing <br />conducted under this Article may be utilized in any criminal prosecution against that <br />person under this Article. <br />(i) Hearings conducted by the Commission shall be recorded by court <br />reporter, video recorder or such other means as the Commission may determine to <br />Page 2 <br />
