• 0 <br />ensure that a record is available for judicial review under Section 54.039 of the Texas <br />Local Government Article. <br />Section- 3.04. Orders; appeals. <br />(a) The Commission may: <br />(1) Order the repair, within a fixed period of time, of buildings found to <br />be dangerous buildings in violation of city ordinances; <br />(2) Declare a building to be substandard in accordance with the <br />powers granted by subchapter C of chapter 54 of the Texas Local <br />Government Article; <br />(3) Order, in an appropriate case, the immediate removal of persons or <br />property found on private property, enter on private property to <br />secure the removal if it is determined that conditions exist on the <br />property that constitute a violation of an ordinance, and order <br />action to be taken as necessary to remedy, alleviate, or remove <br />any substandard and dangerous building found to exist; <br />(4) Issue orders or directives to any peace officer of the state, <br />including a sheriff, constable or the chief of police, to enforce and <br />carry out the lawful orders or directives of the Commission; and <br />(5) Determine the amount and duration of -the civil penalty the city may <br />recover as provided by .,Section 54.017 of the Texas Local <br />Government Article. <br />(b) Notice of each order issued by the Commission shall be given by mail and <br />by publication and filed in the city secretary's office as provided in Section 54.039(a) of <br />the Texas Local Government Article. <br />(c) Unless a judicial review petition is timely filed as provided by Section <br />54.039 of the Texas Local Government Article, the orders of the Commission shall in all <br />things be final and binding. <br />Section 3.05. Duties of the city attorney. <br />(a) The city attorney shall attend Commission meetings and hearings and <br />render legal counsel to the chairman, or acting chairman of the Commission. <br />(b) In accordance with Section 54.037 of the Texas Local Government Article, <br />the city attorney may initiate and prosecute suits to enforce civil penalty orders issued <br />by the Commission panels. <br />Page 3 <br />
