Council to consider authorization to amend the FY 2003-2004 budget by appropriating $486,435 from the <br />TIRZ to provide for partial funding for the Sylvan Beach Shoreline Protection and Beach Nourishment Project, <br />contingent upon approval of an Amended Project Agreement with the Texas General Land Office for the <br />project. <br />Parks and Recreation Director Stephen Barr presented summary and recommendation and answered Council's <br />questions. <br />City Attorney Knox Askins read: ORDINANCE 2004-2709 — AN ORDINANCE AUTHORIZING AND <br />APPROVING A BUDGET ADJUSTMENT OF THE ANNUAL BUDGET OF THE CITY OF LA PORTE, <br />AND APPROPRIATING AN AMOUNT NOT TO EXCEED $486,435 FROM TAX INCREMENT <br />INVESTMENT ZONE 1 FUTURE REVENUES TO PROVIDE FOR PARTIAL FUNDING FOR THE <br />SYLVAN BEACH SHORELINE PROTECTION AND BEACH NOURISHMENT PROJECT (TGLO <br />COASTAL PROJECT #1114), CONTINGENT UPON APPROVAL OF AN AMENDED PROJECT; <br />MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. <br />Motion was made by Councilmember Ebow to approve Ordinance 2004-2709 as presented by Mr. Barr. <br />Second by Councilmember Young. The motion carried. <br />Ayes: Mosteit, Ebow, Beasley, Griffiths, Engelken, Young and Meismer <br />Nays: None <br />Abstain: None <br />10. Council to consider approval or other action of a Construction Code Adoption Ordinance. <br />Mayor Pro Tern Peter Griffiths asked Interim Planning Director Nick Finan if he would like to add anything to <br />this item. City Manager Debra Feazelle responded that staff had no reports. <br />Motion was made by Councilmember Mosteit to approve Ordinance 96-2079-B adopting the C-3 Codes. <br />Second by Councilmember Ebow. <br />City Attorney Knox Askins read: ORDINANCE 96-2079-B — AN ORDINANCE ADOPTING NEW <br />BUILDING CODES (COMPREHENSIVE CONSENSUS CODES, NATIONAL ELECTRICAL CODE AND <br />INTERNATIONAL CODE COUNCIL) BY AMENDING CHAPTER 82 OF THE CODE OF ORDINANCES <br />OF THE CITY OF LA PORTE; BY AMENDING CHAPTER 82, "BUILDINGS AND BUILDING <br />REGULATIONS", ARTICLE II "BUILDING CODES", SECTION 82-31 "ADOPTION"; SECTIONS 82-32 <br />AND 82-33 "AMENDMENTS"; CHAPTER 82 "BUILDINGS AND BUILDING REGULATIONS", <br />ARTICLE IV "ELECTRICAL CODE" DIVISION 5 "STANDARDS", SECTION 82-337 "ADOPTION", <br />CHAPTER 82 "BUILDINGS AND BUILDING REGULATIONS: ARTICLE VI "ENERGY <br />CONSERVATION CODE" ADDING SECTION 82-411 "PURPOSE" SECTION 82-412 "ADOPTION" <br />AND SECTION 82-413 "AMENDMENTS"; CHAPTER 82 "BUILDINGS AND BUILDING CODE <br />REGULATIONS" ARTICLE VII "MECHANICAL CODE" SECTION 82-441 "ADOPTION"; PROVIDING <br />A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT ANY PERSON <br />VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO <br />THOUSAND DOLLARS; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Mayor Pro Tern Griffiths stated they are now open for discussion. <br />Ayes: Mosteit, Ebow and Beasley <br />Nays: Meismer, Young, Griffiths and Engelken <br />Abstain: None <br />
