City Council Regular Meeting — Mat, 2004 - Page 4 • <br />The motion failed. <br />Motion was made by Councilmember Meismer to approve Ordinance 96-2079-B adopting the ICC Codes. <br />Second by Councilmember Young. The motion carried. <br />City Attorney Knox Askins read: ORDINANCE 96-2079-B — AN ORDINANCE ADOPTING NEW <br />BUILDING CODES (INTERNATIONAL CODE COUNCIL AND NATIONAL ELECTRICAL CODE) BY <br />AMENDING CHAPTER 82 OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, BY <br />AMENDING CHAPTER 82, "BUILDINGS AND BUILDING REGULATIONS", ARTICLE II "BUILDING <br />CODES", SECTION 82-31 "ADOPTION", SECTIONS 82-32 AND 82-33 "AMENDMENTS", CHAPTER <br />82 "BUILDINGS AND BUILDING REGULATIONS", ARTICLE III "PLUMBING CODE" SECTION 82- <br />66 "ADOPTION' AND SECTION 82-67 "AMENDMENTS", CHAPTER 82 `BUILDINGS AND <br />BUILDING REGULATIONS", ARTICLE IV "ELECTRICAL CODE" DMSION 5 "STANDARDS", <br />SECTION 82-336 "ADOPTION", CHAPTER 82 "BUILDINGS AND BUILDING REGULATIONS", <br />ARTICLE VI "ENERGY CONSERVATION CODE", AND SECTION 82-413 "AMENDMENTS", <br />CHAPTER 82 "BUILDINGS AND BUILDING CODE REGULATIONS", ARTICLE VII "MECHANICAL <br />CODE" SECTION 82-441 "ADOPTION" AND SECTION 82-442 "AMENDMENTS", PROVIDING A <br />REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; PROVIDING A SEVERABILITY CLAUSE; PROVIDING THAT ANY PERSON <br />VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO <br />THOUSAND DOLLARS; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />Mayor Pro Tern Griffiths stated they are now open for discussion. <br />Ayes: Meismer, Young, Griffiths and Engelken <br />Nays: Mosteit, Beasley and Ebow <br />Abstain: None <br />The motion carried. <br />11. Council to consider approving utilization or other action of an interlocal agreement and expenditure of <br />computer funds to the State of Texas Department of Information Resources. <br />MIS Manager Larry Mabe presented summary and recommendation and answered Council's questions. <br />Motion was made by Councilmember Engelken to approve utilization of an interlocal agreement and <br />expenditure of computer funds to the State of Texas Department of Information Resources as presented by Mr. <br />Mabe. Second by Councilmember Young. The motion carried. <br />Ayes: Mosteit, Ebow, Griffiths, Engelken, Young and Meismer <br />Nays: None <br />Abstain: Beasley <br />12. ADMINISTRATIVE REPORTS <br />City Manager Debra Feazelle reminded Council and Staff of the Texas Municipal League Impact of School <br />Finance Seminar on Friday, March 12, 2004, in Austin, Texas; Council Work Sessions Pre -budget Workshop <br />on Monday, March 15, 2004, from 6 p.m. until 9 p.m.; the 2004 HGAC General Assembly Meeting on Friday, <br />March 19, 2004 at 6:30 p.m. at the Westin Galleria Hotel; the NLC Presentation in Washington, DC with <br />elected officials; and City Planner Wayne Sabo was introduced. <br />13. COUNCIL COMMENTS <br />Councilmembers Engelken, Griffiths, Beasley, Ebow, Meismer, Young and Mosteit had comments. <br />
