Assistant City Attorney Clark Askins read: ORDINANCE 2004-2719 through 2004-2727 - AN ORDINANCE DECLARING THE BUILDING(S) LOCATED ON LOT(S) 1-6 & 11-16 ADJ. 16' ALLEY, BLOCK 18; ADDITION SYLVAN BEACH, HARRIS COUNTY, TEXAS, TO BE IN FACT A NUISANCE; ORDERING SUCH BUILDING(S) CONDEMNED; FINDING THAT JOE NEVARRO FOR 200 GARFIELD, LLP IS THE RECORD OWNER(S) OF SAID PROPERTY; ORDERING THE SAID OWNER(S) TO ENTIRELY REMOVE OR TEAR DOWN SUCH BUILDING(S); ORDERING SAID OWNER(S) TO COMMENCE SAID REMOVAL OR DEMOLITION WITHIN (10) DAYS FROM THE EFFECTIVE DATE OF THIS ORDINANCE; ORDERING THE DANGEROUS BUILDING INSPECTION BOARD TO PLACE A NOTICE ON SAID BUILDING(S); ORDERING THE CITY SECRETARY TO FORWARD A COPY OF THE ORDINANCE TO SAID OWNER(S); PROVIDING FOR THE REMOVAL OF SAID BUILDING(S) BY THE CITY OF LA PORTE IF NOT REMOVED BY SAID OWNER(S) IN THE MANNER PROVIDED HEREIN; PROVIDING AN EFFECTIVE DATE HEREOF; AND FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW. citizens in Public Hearing. Open Public Hearing -Mayor Pro Tem Griffiths opened the Public Hearing at 7:09 p.m. Council to consider taking action on recommendation for denial by P&Z for 28.43 acres of land located at the southeast corner of McCabe Road and SH 146. The applicant, Mr. Robert Burchfield, seeks SCUP for multi- family development in PUD zone. Interim Planning Director Nick Finan presented summary and recommendation and answered Council's questions. In addition, he informed City Council that Mr. Rush and Mr. Burchfield are requesting this item not be voted on this evening to provide them the opportunity to return to the Planning and Zoning Commission. Public Input: Robert Burchfield of Houston, Texas, requested Council not to vote this evening, allowing them to return to the Planning and Zoning Commission to work out additional details. Tom Northrup of Houston, Texas, ran out of time to meet regulations and is requested to return to Planning and Zoning Commission for approval to move forward with the projects, once all the regulations have been met. The Planning and Zoning Commission recommends Council to consider taking action on recommendation for denial by Planning and Zoning for 28.43 acres of land located at the southeast corner of McCabe Road and SH 146.
