<br />City Council Regular Meeting, Public Hearing and Workshop Meeting - November 8,2004 - Page 3 <br /> <br />PORTE, HARRIS COUNTY, TEXAS; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Engelken to approve the Addendum as presented. Second <br />by Councilmember Griffiths. <br /> <br />Ayes: Beasley, Engelken, Moser, Mosteit, Rigby, Clausen, Porter, Ebow and Griffiths <br />Nays: None <br />Abstain: None <br /> <br />6. PETITIONS, REMONSTRANCES, COMMUNICATIONS, AND CITIZENS AND TAX <br />PAYERS WISHING TO ADDRESS COUNCIL ON ANY ITEM POSTED ON THE AGENDA <br /> <br />Melvin Walker of2219 Underwood Road, La Porte, Texas, spoke of his concerns with the City <br />Attorney and zoning issues. <br /> <br />Bill Scott was not present to speak. <br /> <br />7. Open Public Hearing - Mayor Porter opened the Public Hearing at 6:38 p.m. <br /> <br />Review by Staff - Interim Planning Director Wayne Sabo provided an overview of an ordinance <br />for 11.416 acres ofland located at 101 E. Barbour's Cut Boulevard to be rezoned from LI and HI <br />to PUD for future expansion of the facility. <br /> <br />Interim Planning Director Wayne Sabo presented summary and recommendation and answered <br />Council's questions. <br /> <br />Public Input - There were no citizens wishing to provide public input. <br /> <br />Recommendation of Staff - Unanimously, The Planning and Zoning Commission recommended <br />taking action on an ordinance for 11.416 acres ofland located at 101 E. Barbour's Cut Boulevard <br />to be rezoned from LI and HI to PUD for future expansion of the facility. <br /> <br />The Public Hearing was closed at 6:45 p.m. <br /> <br />8. Council to consider approval or other action regarding Ordinance 1501-CCCC and #R04-009. <br /> <br />Interim Planning Director Wayne Sabo presented summary and recommendation and answered <br />Council's questions. <br /> <br />Assistant City Attorney Clark Askins read: ORDINANCE 1501-CCCC and #R04-009 - AN <br />ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, <br />CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF <br />THE CITY OF LA PORTE, BY CHANGING THE ZONING CLASSIFICATION FROM <br />LIGHT INDUSTRIAL AND HEA VY INDUSTRIAL TO PLANNED UNIT DEVELOPMENT <br />AS REQUESTED FOR THE PROPERTY LOCATED AT 101 E. BARBOUR'S CUT <br />BOULEVARD HEREIN DESCRIBED; MAKING CERTAIN FINDINGS OF FACT RELATED <br />TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Ebow to approve Ordinance 1501-CCCC and #R04-009 as <br />presented by Mr. Sabo. Second by Councilmember Moser. The motion carried. <br />
