City Council Regular Meeting, Workshop Meeting and Public Hearing - June 13, 2005 Page 3 Open Public Hearing - Mayor Porter opened the Public Hearing at 6:42 p.m. Review by Staff - Director of Planning and Community Development Wayne Sabo provided an overview on recommendation for approval by Planning and Zoning on Zoning for allowing off-site parking for a medical clinic located at 404 West Fairmont Parkway. Public Input - None. Recommendation of Planning and Zoning - Unanimously, the Planning and Zoning Commission recommended approval with special conditions list in SCUP. The Public Hearing was closed at 6: 47 p.m. 10. Council to consider approval or other action regarding Ordinance 1501-QQQQ. Assistant City Attorney Clark Askins read: CONSIDER APPROVAL OF OTHER ACTION OF AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING A SPECIAL CONDITIONAL USE PERMIT #SCU05-005 FOR THAT CERTAIN ARCEL OF LAND DESCRIBED AS FOLLOWS, TO-WIT: 0.43 ACRE, PT. OF LOTS 5-6, BLOCK 177, TOWN OF LA PORTE, JOHNSON HUNTER SURVEY, ABSTRACT 35, LA ORTE, HARRIS COUNTY, TEXAS, FOR THE PUROSE OF DEVELOPING OFF-SITE PARKING FOR LA PORTE MEDICAL CLINIC (DR. DILIP PATEL); MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF; Motion was made bv Council member Moser to approve Ordinance 1501-0000 as presented bv Mr. Sabo with conditions listed in SCUP. Second by Councilmember Engelken. The motion carried. Ayes: Mosteit, Engelken, Rigby, Moser, Beasley and Mayor Porter Nays: None Abstain: None 11. Council to consider approval or other action regarding adopting an ordinance implementing Policeman Civil Service under V.A.T.s. 1269m; which has since been codified into V.A.T.S. Local Government Code Chapter 143. Chief Richard Reffpresented summary and recommendation and answered and answered Council's questions. Motion was made by Council member Moser to approve the agenda as presented. Second by Council member Engelken. Motion carried. Ayes: Mosteit, Engelken, Rigby, Moser, Beasley and Mayor Porter. Nays: None Abstain: 12. Council to consider approval or other action regarding an Ordinance appointing positions to fill the remaining vacancies on Boards and Commission. Assistant City Attorney read: ORDINANCE 2004-2782-G - AN ORDINANCE APPOINTING MEMBERS TO VARIOUS BOARDS, COMMISSIONS AND COMMITTEES, OF THE CITY OF LA PORTE; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
