<br />departments within the City In order to prepare a final report <br />for the City Council. <br /> <br />In conjunction with the City's argument that the requested <br />information does not constitute a completed report, the City of <br />La Porte would argue that the information requested is exempt <br />from public disclosure pursuant to 552.111 of the Public <br />Information Act. Specifically, the City of La Porte believes that <br />under ~552.111 the subject report and related documentation <br />constitutes an interagency and/or interagency communication that <br />relates to the City of La Porte's policy making mission. In this <br />regard the City would show that the purpose of the investigation <br />is to develop salary and benefits policy relating to all city <br />employees (as opposed to a particular employee), and relates to <br />advice and recommendations on general policYmaking matters <br />ultimately decided by the La Porte City Council. <br /> <br />The City would note that the requested materials relate to a <br />category broader than mere personnel matters. In Open Records <br />Decision No. 631 (1995), the Attorney General's Office held that <br />when personnel matters are of such a nature as to impact the area <br />of a governmental body's policy mission, they can be considered <br />part of "policy-making functions". Accordingly, the City of La <br />Porte seeks to exclude the full content of the report. <br /> <br />Finally, should your office determine that the report is not <br />protected from disclosure, the City of La Porte would ask that <br />your office redact all parts or severable sections of the report <br />that relate to the policy-making functions of the city and would <br />therefore qualify under the above referenced exceptions. <br /> <br />This letter constitutes a request for an opinion as to the <br />disclosure of the information attached.
