<br />Minutes of Regular Meeting, Public Hearings and Workshop Meeting held on January 12, 2009 <br /> <br />Page 4 <br /> <br />The Public Hearing was closed at 6:37p.m. <br /> <br />Recommendation of the Planning and Zoning Commission - recommended Council to <br />approve the Rezone Request #R08-002, rezoning 26.8206 acre tract located at 727 Old <br />Underwood Road from General Commercial and Large Lot, to Planned Unit Development <br />(Ord. 1501-06) <br /> <br />10. Council to consider approval or other action regarding Ordinance 1501-06. <br /> <br />Assistant Clark Askins read Ordinance 1501-06, AN ORDINANCE AMENDING THE <br />CODE OF ORDINANCES OF THE CITY OF LA PORTE, CHAPTER 106, MORE <br />COMMONLY REFERRED TO AS THE ZONING ORDINANCE OF THE CITY OF LA <br />PORTE, BY CHANGING THE ZONING CLASSIFICATION FROM GENERAL <br />COMMERCIAL AND LARGE LOT RESIDENTIAL TO PLANNED UNIT DEVELOPMENT <br />FOR PROPERTY LOCATED AS 727 OLD UNDERWOOD ROAD, FURTHER <br />DESCRIBED AS 26.8206 ACRE TRACT, ENOCH BRINSON SURVEY, ABSTRACT NO.5 <br />AND NICHOLAS CLOPPER SURVEY, ABSTRACT NO. 198, LA PORTE, HARRIS <br />COUNTY, TEXAS; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE <br />SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND <br />PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made bv Councilmember Black to approve Ordinance 1501-06 as presented <br />bv Mr. Tietiens. Councilmember Rigby seconded the motion. Motion carried. <br /> <br />Ayes: Mosteit, Moser, Rigby, Black, Clausen, Ebow, Engelken, and Porter <br />Nays: Malone <br />Abstain: None <br />Absent: None <br /> <br />11. Public Hearing - Council to consider recommendation of the Planning and Zoning <br />Commission regarding Rezone Request #R08-004 to deny rezoning 0.57 acre of land <br />located in the 500 block of N. 7th Street from R-2 (Residential) to General Commercial <br />(Ord. 1501-P6) <br /> <br />Open Public Hearing - Mayor Porter opened the Public Hearing at 6:40 p.m. <br /> <br />Planning Director Tim Tietjens presented summary and recommendation and answered <br />Council's questions. <br /> <br />Public Comments: There were no public comments. <br /> <br />The Public hearing was closed at 6:42 p.m. <br /> <br />Recommendation of Planning and Zoning Commission - recommended Council to deny <br />the Rezone Request #R08-004 rezoning 0.57 acre of land located in the 500 block of N. 7th <br />Street from R-2 (Residential) to General Commercial (1501-P6) <br />
